FINAL DIRECT RULEMAKING: USEC PRIVATIZATION ACT -
AMENDMENT OF 10 CFR PARTS 2,40,70, and 76 As requested in Frank Costanzi's November 6,1996 memo, OC has reviewed the final direct rulemaking package amending Parts 2,40,70, and 76 to bring these regulations into conformance with the new 'USEC Privatization Act" and the associated revision to NRC's Enforcement Policy (NUREG-1600 ' General Statement of Policy and Procedures for NRC Enforcement Action'). We find that there are no new or unresolved resource-related issues l
sinen our review and concurrence in the 'rulemaking plan' on August 22,1996. OC also l
reviewed this package for fee implications and found none - fee categories were amended previously to move uranium enrichment facilities from Part 50 to Part 70 for fee purposes.
OC concurs in this package.
Before submitting the package to the EDO, you will need to address resources in the Commission Paper, as required by the EDO in his June 14,1991 memo. I recommend the following:
