TOWN OF KENSINGTON'S ANSWER OPPOSING THE APPLICANTS' MOTION FOR
SUMMARY
DISPOSITION OF KENSINGTON CONTENTION #7 Pursuant to 10 CFR 2.749, on the basis of the affidavit of Sandra Gavutis and the statement of undisputed facts attached hereto, the Town of Kensington moves the Board to enter an order d ismissing the motion for summary disposition by the Applicant for Kensington Contention #6 on the grounds that this summary disposition i@ premature without the revised updated radiological emergency response plan served upon the parties to this proceeding.
The statement of facts not in dispute and the affidavit of Sandra Gavutis will.. demonstrate that'there is no showing that the documents referred to in the William T.
Wallace affidavit will actually be included in the revised Kensington or State radiological emergency response plan.
STATEMENT OF FACTS NOT IN DISPUTE 1.
There has been no showing that the information in the May 19, 1986 William T. Wallace affidavit is, or will be, included in a Kensington or New Hampshire State Radiological Emergency Response Plan.
2.
There has been no evidence served upon the parties to this proceeding to indicate that a revised draft radiological emergency response plan has been, or will be, issued which would include the information in the William T.
Wallace affidavit.
