Dear Mr. Stello:
This is an appeal, pursuant to subsection (a) (6) of the Freedom of Information Act as amended (5 U.S.C.
552), of the effective denial of the Commission to release documents requested on January 21, 1985 by the Government Accountability Project (GAP) regarding the Comanche Peak nuclear power plant, specifically Inspection Report 50-445/84-39.
A March 15, 1985 response from J.M.
Felton advised of one document " determined to be the only record" found which was responsive to our request.
We were not informed in that letter that the matter was considered closed.
On February 10, 1986 we wrote to request the status of this matter and received a February 14, 1986 response from Mr. Grimsley stating your office considered the matter completed.
We strongly believe that there are additional documents responsive to our request and ask that an adequate search be conducted at this time or tliat your' office provide us with documentation as to the steps taken to find all materials responsive to our initial request.
We expect your response to this appeal within 20 working -
days so that we can determine whether to pursue this matter in court.
