FEMA Interim Finding This letter acknowledges our receipt of the joint response of Consolidated Edison Company of New York, Inc. and the Power Authority of the State of New York concerning the Federal Emergency Management Agency's (FEMA's) September 17, 1986 interim findings for the Indian Point site, which was requested by this office in our letter dated September 19, 1986.

Your response, dated September 29, 1986, which describes (1) the current status of the issues identified in FEMA's report, (2) your plans and schedules for correcting unresolved issues, and (3) your views regarding the signifi-cance of these findings with respect to the State of Emergency Preparedness at the Indian Point site will be forwarded to FEMA for their assessment and report. We will contact you should additional information be requested by FEMA regarding the resolution of this matter.

7he Nuclear Regulatory Commission (NRC) received the enclosed Federal Emergency Management Agency (FEMA) memorandum dated September 17, 1986 which refers to the state of emergency preparedness around your reactor site at the Indian Point Nuclear Power Station. Attached to the FEMA memorandum is their report dated September 17, 1986, entitled " Interim Finding - Indian Point,"

prepared by FEMA Region II. The report provides FEMA's findings on several unresolved issues in the four counties that comprise the 10-mile emergency planning zone for the Indian Point site.

While progress has been made in responding to these issues, FEMA stated that they were " unable to provide reasonable assurance that the public health and safety of school children in the four-County Emergency Planning Zone at Indian Point can be protected." The FEMA report goes on to state that certain addi-tional material has been submitted relative to correcting certain of the deficiencies yet this information has not been considered in the FEMA report.

The NRC has not been apprised of the current status of these corrective actions.

We are of the view that the unresolved issues identified by FEMA and referred to in their report must be remedied in order for the NRC to conclude that appropriate protective actions can and will be taken in the event of a radio-logical emergency at your facility.

Accordingly, you are requested to submit a written statement to this office within 10 days of the date of this letter, describing (1) the current status of the issues identified in FEMA's report, (2) your plans and schedules for ,

correcting the unresolved issues, and (3) your views regarding the significance of these findings with respect to the State of Emergency Preparedness at the Indian Point site. We consider the FEMA findings to apply equally to Units 2 and 3, and suggest you coordinate your reply. This request affects fewer than ten licensees and therefore, is not subject to the Paperwork Reduction Act of 1980 (PL 96-511). "
