Dear Owen:

In response to your memorandum of August 14, 1985, I have considered the Supplemental Safety Evaluation Reports for Comanche Peak and offer the following comments. e I do not consider it appropriate for the ACRS to review the subject SSERs (and the technical concerns and allegations they contain). My reasons are as follows:

1. The concerns relate primarily to the areas of construction practices and quality control, and the NRC Staff is not requesting that the ACRS review these documents.
2. The NRC has informed Peter B. Bloch, Chairman and Administrative Judge of the ASLB of this recommendation (lack of a request) on their part.
3. On the basis nof the recently released report of the Panel on ACRS Effectiveness, the issues in question are not of the type that the ACRS should be devoting its time to.
