SUBJECT:

NUREG-0797, COMANCHE PEAK SUPPLEMENT SAFETY EVALUATION REPORTS (SSERs) NOS. 7 THROUGH 11 During the 304th meeting of the ACRS, the Comittee discussed the possibility of the Comanche Peak Subcommittee holding a meeting to review the subject SSERs. The Committee decided that each member should be provided with a set of the subject SSERs (which provide the results of the staff's evaluation and resolution of technical concerns and allegations, primarily in the areas of construction practices and ouality control inspection), and of the correspondence pertaining to this issue.

Each member is requested to review these materials prior to the 305th ACRS Meeting, September 12-14, 1985, during which this matter will be broached to ascertain the advisability of holding a subcommittee meeting -

and of the full Committee considering this matter subsequently.

The sequence of events leading up to the current situation is as follows:

1. In an April 30, 1985 memorandum to the NRC Staff entitled, "Importance of SERs," Peter'B. Bloch, Chairman and Administrative Judge of the ASLB, requested that Comanche Peak 1 and 2 SSERs 7, 8 and 9 and others that had not yet been issued be forwarded to the ACRS for its consideration. Subsequent to this memorandum, SSERs 10 ard 11 have been issued. Thus an implied, but not explicit, request for ACRS review of the SSERs was made (Enclosure 1)
2. In a July 26, 1985 memorandum (Enclosure 2) for D. Ward, ACRS Chairman, V. Noonan, Director of Comanche Peak Project, referred to.

ASLB Chairman Bloch's memorandum in responding to his request. The ACRS has subsequently received a total of 20 copies of each of SSERs 7 through 11, a set of which is enclosed for your review.

3. Discussions of this matter between 0. Merrill, ACRS Staff, and V. Noonan regarding the possibility of an ACRS Subconnittee meeting and subsequent full Committee review of the Subcommittee's findings led to Mr. Noonan's writing two additional memoranda:

(1) An August 9, 1985 memorandum for D. Ward (Enclosure 3) which clarified Mr. Noonan's memorandum of July 26, 1985, and stated explicitly that "the staff is not requesting that the ACRS review these documents." He further stated that the staff will follow up on the matters raised in these SSERs to assure that proper corrective action is taken.

(2) The second memorandum (Enclosure 4) is a Board Notification

, for the Commissioners from Mr. Noonan, written in response to Chairman Bloch's April 30, 1985 memorandum. This memorandum advises the Commission, Chairman Bloch and other recipients of the memorandum of the Staff's response to Chairman Bloch's request, and stated that the staff is not requesting the ACRS to review these documents.

For your convenience, a Summary Sheet, identifying by groups the various Technical Concerns and Allegations (TCA) (SSERs 7-10), and the Quality Assurance and Quality Control (QA/QC) issues (SSER No. 11) is provided (Enclosure 5).
