DOW CORNING INC.: ALLEGED MATERIAL FALSE STATEMENTS AND ALLEGED DELIBERATE FAILURE TO FILE A PART 21 NOTIFICATION (0! CASE NO. 3-93-028R) 33 memorandum of February 10, 1995, Eugene i. Pa lik, Director, Office of Investigations (01) Field Office, Region III, informed you that 01 closed its investigation concerning Dow Corning based upon their finding of no underlying 7 violation of regulatory requirements. In accordance with Office of Nuclear Reactor Regulation (NRR) Office Letter No.1001, the Division of Systems Safety and Analysis staff reviewed the bases for closure of the investigation.

We have independently reviewed the facts and conclude that there is no safety significance to the issue raised and closure is appropriate. Closure of this case by 0! will not impact the ongoing NRR technical review of other penetration seal allegations and issues.

ThisLinvestigation was initiated on December 1, 1994, to determine if Brand Industrial Services Company (BISCO) personnel made deliberate material false ~

statements in reporting of qualification testing conducted on their fire penetration seals which were sold to the nuclear power industry. The BISCO qualification test reports were subsequently used by utilities, licensed by the U.S. Nuclear Regulatory Commission (NRC), to substantiate that the licensee met NRC requirements.

Based on the evidence developed during the investigation, it is concluded that BISCO personnel did not deliberately rite material falso statements in their reporting of qualification testing for fire penetration seals.
