TECHNICAL REVIEW OF BISCO FIRE TESTS (01 CASE NO. 3-94-068)

On September 20, 1994Q Clayton W. BRQWN, the former BISCO president and now a consultant tc,11500 was interviewed durlog the Dow Corning investigation (01 Case Na, 3-97-028). During the interview BROWN wade statements that indicate that- BISCO may have made misrepresentationssin the qualification testing they conducted at Construction Technology Laboratories (CTL) for their fire penetration seal system.

<8ROWN3tated that BISCO conducted their qualification testing for their fire

' penetration seal system at CTL, Skokie, Illinois. According tar BROWN SISCO constructed the test article at BISCO without any QC supervision by CTL. The test article was thendransported to CTL, where the test was performed in ,

CTL's furnace. ~ BROWN commented that to expedite matters in some cases, BISCO would write the test report, which then would be reviewed and critiqued by CTL.. . BROWN said that the report would be issued under a CTL cover letter.

~ BROWN described CTL's role in the fire testing as providing the furnace, monitoring temperatures during the test, and conducting the hose stream test.

A redacted copy of BROWH'5 interview was provided to your office on December 6, 1994.

Attached are several. 81SCb fire test reports obtained from. a source outside of BISCO These reports are what we believe 3ROWN was describing in his interview; It is requested that your ' office review the tests to determine if there are any apparent misrepresentations of the conduct of the test and CTL's role as testing-laboratory. It is also requt.sted that your office determine; I) Whether there is a requirement for a otility to have a test performed by an independent laboratory to qualify their fire cenetration seals. -
