SUBJECT:
DRAFT NRR OFFICE LETTER N0. 50: POLICY AND PROCEDURE FOR THE DISPOSITION OF INVESTIGATIVE REPORTS AND RELATED INFORMATION RECEIVED FROM THE OFFICE OF INVESTIGATIONS The subject draft office letter is enclosed for your comment. However, it is to be implemented immediately. The more important provisions are:
1.
Division Directors are responsible for ensuring that 0! reports covering their plants and areas of responsibility are thoroughly reviewed. The fact that the transmittal memorandum accompanying these reports is normally addressed to a Regional Administrator does not relieve you of this responsibility.
2.
Division Directors are responsible for preparing a memorandum to the
. Director, NRR, summarizing the report. This memo must also include:
a.
An assessment of the conclusions reached by 01. This is to be based on your independent review of the evidence presented in the report.
It is important to note that we are not bound by the report's conclusions. We are, however, bound by the evidence presented in the report. OELD is also being tasked with reviewing these reports.
You may confer with OELD as necessary, b.
The identification and assessment of the safety significance of the technical and managerial issues raised by the report.
The plan and schedule for addressing the issues raised by the c.
report.
(This may include oversight of Regional action items.)
d.
The impact of the report on continued plant operations, on pending licensing decisions, or other licensing activities.

. In addition to the above which pertains to the ongoing process of reviewing 01 reports as they are received, Division Directors must also ensure that all closed cases on NT0Ls are aiso reviewed, as above.
In these cases the memorandum to the Director, NRR, may include the summary of more than one 01 report. Normally, the memorandum required by 2., above, should be f
received by the Director, NRR, within 15 workdays of your receipt of the 01 report. For Palo Verde 2 and Hope Creek I would like to have your response by April 4, 1986.
6 DPAS will be asking for your comments on the draft office letter in the near future.
It will then be finalized and issued to all NRR employees.

NRR OFFICE LETTER NO. 50:
POLICY AND PROCEDURE FOR THE DISPOSITION OF INVESTIGATIVE REPORTS AND RELATED INFORMATION RECEIVED FROM THE OFFICE OF INVESTIGATIONS PURPOSE:
This procedure has been developed to assure that investigation reports and related correspondence received from the Office of Investigations (01) are reviewed by NRR and that appropriate action is taken.
I BACKGROUND

OI has bee'n' assigned by the Commission the responsibility for conducting investigations involving alleged or suspected wrongdoing by NRC licensees l
or their contractors; documenting those investigations in an appropriate report; and infonning agency managers of the results of their investigation.
Generally, OI investigations do not involve technical concerns, although the Regions or Headquarters.may followup certain technical concerns concurrent with an 01 investigation, or as a result of an investigation.
Most OI investigations result from a request from a Regional. Administrator.
Completed 01 investigation reports are sent to the requester as an enclosure to a letter from the Director, 01. NRR receives copies of all OI investigative reports concerning power reactors. Due to their sensitive nature and the potential for enforcement action or criminal prosecution, these reports receive a very limited distribution and must be handled as sensitive infonnation.
The Executive Director for Operations has directed all Regional Administrators and Program Office Directors to (1) adopt internal procedures for processing investigation re gations; and (3) ports received from OI; (2) keep abreast of ongoing investi-review results of completed investigations to determine the impact on their areas of responsibility. The memorandum further states that while the appropriate Regional Administrator will nonnally be responsible for resolving matters involving a specific licensee or vendor, all recipients of 01 reports shall be responsible for initiating actions to resolve matters having generic implications or broad programmatic impact.
c.
RESPONSIBILITIES:
1.
The NRR Office Allegation Coordinator (0AC) is responsible for:
Routing all 01 reports and related correspondence to the a.
appropriate NRR Division for review.
If more than one plant is involved, the material will be routed to all involved project

Maintaining a file of all 0I reports and related correspondence,
for three. years from the date of issuance of the report. This

will include a copy of the memorandum to the Director, NRR, from the Division Director summarizing the report and the actions required.
2.
NRR Division Directors who receive OI reports for review are responsibic for:
a.
Ensuring that 0I reports are reviewed.
b.
Ensuring that the review is documented in a memorandum to the Director, NRR.
Ensuring that the actions in the memorandum to the Director. NRR, c.
are followed up.
PROCEDURE:
1.
All 01 reports and related correspondence received by the Director, NRR, will be forwarded to the OAC for handling.

Because of the size of some OI reports, the complete OI report may not be routed. The OAC will indicate on the routing memorandum if additional information or attachments are available.
4.
All OI reports will be routed in sealed envelopes or hand carried.
5.
All NRR personnel involved with the review of OI reports shall take appropriate action to assure that the contents of these reports and related correspondence are not released to those without a right and need to know the information.
In no case shall infonnation contained in 01 reports be released to individuals outside the NRC without the l
permission of the Director. 01, and the Deputy Director, NRR.
6.
Division Directors shall prepare a memorandum to the Director, NRR, summarizing the report. This memorandum is due to the Director, NRR, within 15 workdays of the Project Divisions' receipt of the report.
The memorandum must not contain identification of confidential allegers and shall receive limited distribution.
In addition to summarizing the OI report, the memorandum must also include:
a.
An assessment of the conclusions reached by 01. Note that NRR is not bound by the report's conclusions. We are, however, bound by the evidence presented in the report. OELD is also being tasked with reviewing these reports.
You may confer with OELD as necessary, b.
