Purpose:

To discuss a conceptual design for a disposal facility and requirements of 10 CFR Part 61.

Sumary: Dames & Moore, CNSI's principal contractor for current developmental work in South Dakota, presented basic information on the major properties of shale stratigraphy, geology, and hydrogeology. Some of these properties were:

Shale has relatively low permeability, Deep artesian features are present, Terrain is generally rolling, Layers of weathered shale are present.

Water Table levels are relatively shallow.

Dames & Moore also presented the basics of a conceptual design for a disposal facility to serve as a model for discussions with NRC representatives present on whether the design could meet requirements of Part 61. The conceptual design included engineered trenches, bentonite slurry walls, and surface feature engineering for control of water. ,

NRC emphasized that the analysis presented in any license application that may include engineering features such as those presented by Dames & Moore would have to show that the

' 9 performance objectives of Part 61 would be met. NRC assured CNSI that the framework of Part 61 included the necessary flexibility to license engineered facilities such as the conceptual design presented. NRC established that credit for engineered features in the analysis demonstrating that the performance objectives would be met will be considered.

However, natural site features will be the primary consideration in meeting the minimum site suitability criteria, and engineering features may not be allowed to compensate for an unsuitable site. NRC stressed that a licensee must demonstrate the case that a site is suitable to the NRC in its license application. NRC reiterated that a license review under Part 61 for an engineered alternative without protracted hearings, could take from 2 to 31 years. NRC told CNSI to expect 2 rounds of questioning during license review for a design like the one discussed.
