Dear Mr. Pay:

This is in response to your letter dated August 17, 1985, in which you requested, pursuant to the Freedom of Information Act, copies of records since January 1,1985, concerning (1) low-level radioactive waste disposal in South Dakota and (2) agreement state status for South Dakota.

During a September 3,1985, telephone conversation with Mr. Stephen Isaacs of my staff, you agreed to pay for the requested records, which are listed on the enclosed appendix.

The charges for reproducing records not located in the NRC Public Document Room (PDR) is five cents ($0.05) per page, as specified in 10 CFR 9.14(b).

Accordingly, the cost of reproducing the enclosed 233 pages is $11.65. You will be billed for the total amount of pages reproduced by our Division of Accounting and Finance.

For your infonnation, NRC staff have advised this office of a November 29, 1983, videotape from Chem-Nuclear Systems, Inc., entitled " Questions South Dakotans Ask About Low-Level Nuclear Waste." This is a tape of a television program aired on South Dakota Public Television presenting questions and answers on low-level waste. The television program was aired prior to the 1984 elections in which South Dakota voters had referendum votes on their ballots concerning low-level waste and the development of a site for low-level waste disposal. The individual to contact at Chem-Nuclear regarding this tape is:
