This refers to your letter dated February 13, 1987 in response to our letter

dated January 23, 1987 concerning the termination of the employment of a former Health Physics technician at Beaver Valley, Unit 1.

After reviewing your basis for this termination, we have determined that enforcement action is not warranted. However, whenever an employee is discharged after having raised safety concerns, even though the discharge is for legitimate reasons, co-workers may perceive the discharge as retaliatory. Therefore, it is impor-tant for all licensees to emphasize that employees may raise safety concerns without fear of reprisals as a counter to the potentially intimidating effect of such perceptions. We have noted the policies and programs, as described in your letter, designed to encourage employees to identify safety concerns, and we will continue to examine these programs during future inspections.

In your response, you also request that the February 13, 1987 letter and its attachments be withheld from public disclosure.

In support of this request, you state that the letter and attachments describe specific personnel-related activities, and disclosure would constitute a clearly unwarranted invasion of personal privacy.

It is the practice of the NRC to withhold from public dis-closure, under 10 CFR 2.790(a)(6), only segregated parts of documents that contain medical information or other intimate personal information, the dis-closure of which would be a clear and unwarranted invasion of personal privacy.

Examples of such information include social security numbers, home addresses, telephone numbers or the names of family members.

Further, information of a personal nature concerning family disputes or personal habits are also appro-priate for withholding under subsection (a)(6). However, information concern-ing the manner in which an individual conducted himself in the course of his professional responsibilities is generally not considered personal and there-fore not appropriate for withholding by reason of subsection (a)(6).

The February 13 letter cites no specific, personal information, but rather makes a broad request to withhold the entire letter and attachments. Conse-quently, unless you provide this office with specific sections of the letter 8704300182 870423 t'

and attachments that contain information of an intimate personal nature, unrelated to an individual's job responsibilities, or provide other justifi-cation regarding disclosure, your February 13, 1987 letter and its attachments will be placed in the NRC public document room 20 days after the date of this letter.
