ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket No. 50-369 McGuire Unit 1 License No. NPF-9 During the Nuclear Regulatory Commission (NRC) inspection conducted on February 21 - March 20,1987, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violation is identified below:
Technical Specification 6.8.1 requires that written approved procedures be established, implemented and maintained covering the operation and maintenance of safety related plant equipment.
Station Directive 4.4-2 Control Of Temporary Modifications defines a lifted lead as one of fourteen types of temporary modifications and delineates the administrative controls designed to maintain management of plant equipment. Activities directly related to an active ongoing test procedure may be excluded form the requirements of directive 4.4.2 if the controls embodied in the test procedure are equal to those of the directive.
Contrary to the above, on February 10, 1987, licensee personnel lifted a Unit. Refueling Water Storage Tank heater control rendering the circuit inoperable without employing the requirements of Station Directive 4.4.2 or an active test procedure.
This is a Severity Level IV Violation (Supplement I) and is applicable to Unit 1 only.
Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further viola-tions, and (5) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending the response time.
