and the Ladditional information needed to complete our evaluation prov, dad by
telephone on January 27, 1987, relating to our Notice of Violation issued on

' August 5,1986 concerning activities conducted at your McGuire facility.- We

conclude that the violation issued in the Notice of violation for McGuire Unit 2
L
is correct.
The change in leak rate resulting from repairs or' adjustments made
l
to the fuel transfer. tube blind flange and containment building equipment hatch
l
l'
prior; to the Type A test was not measured.
Consequently the adjustment to
determine the "as is" -(also called "as found") overall- containment leak rate can
not be made for these components.
While the violation is worded to emphasize the requirement to determine the "as
found" containment leak rate, we consider that this requirement also incorporates
the need to establish a quality program which controls safety related activities
to ensure that the required local leak rates are measured, the results document-
ed, and the change in leakage used to determine the overall centainment integrat-
ed leak rate for the "as found" condition.
A program for control of activities
to measure the change in leakage resulting from repairs or adjustments to the
containment boundary was not implemented for the Unit 2 outage.

Failure to measure the leakage corrections made to the containment boundary prior
to the Type A test raises the question of whether the "as found" containment
,
integrated leakage rate is a passed or " failed" leak rate.
Your investigation indicates an overall containment integrated leakage rate for
the "as found" condition of 0.99 La.
The acceptance limit applicable to the "as found" leak rate whether performed in
the "as found" containment condition or calculated by accounting for the change
in -leakage rate made before the Type A test is 0.75 La as specified in Para-
graph III.A.5(b) of Appendix J.
This position is further supported by Para-
graphs III.A.1(a) and III.A.6 of Appendix J.
Consequently, we have classified the May 20 - 26,1986 Unit 2 Type A test as a
" failed" integrated leak rate test for the "as found" containment condition.
Therefore the requirements of Paragraph III.A.6. of Appendix J are applicable.

Our findings in no way preclude your option to submit a Corrective Action Plan
with an alternative test program proposal along with a request for exemption from
the failed as found" containment integrated leak rate classification for NRC
staff review. The reasons for this option are stated in IE Notice 85-71.
