This letter is in response to your letter dated February 24, 1987, which forwarded the NRC staff position concerning 10 CFR 50 Appendix I versus Annex RM 50-2 requirements for Beaver Valley Power Station Units 1 and 2.

In accordance with the staff position report and discussions with NRC representatives on February 25, 1987, and pursuant to 10 CFR 50.12(a)(2)(v), we are hereby requesting a schedular exemption from the requirements of RM 50-2. It is further requested that this exemption remain in effect until six months after the issuance of a full power license for Unit 2. At that time a formal request will be submitted with appropriate justifications for a permanent exemption to the requirements of RM 50-2.

The following is submitted in support of this request:

1. The Technical Specifications, Offsite Dose Calculations Manuals, implementing procedures,, and the attendant training for both units are based on 10 CFR 50 Appendix I. With the expected issuance of the Operating License in April, 1987, an exigent situation exists in that inadequate time is available to revise and implement the requisite changes.
2. Since BV-1 has operated at 20 to 25% of the limits specified in RM 50-2 and BV-2 has been designed to RM 50-2, it can reasonably be expected that the combined site releases will not exceed the RM 50-2 values during the period that the exemption will be in effect. In any case, the limits of Appendix I will be applicable and on this basis, off-site releases will be kept as low as possible.

When the formal request for a permanent exemption is j submitted, it will, as a minimum, contain justification pursuant to 10 CFR 50.12(a)(1) and 10 CFR 50.12(a)(2)(iii).
