By letter dated July 25, 1985, your Company provided your bases for not remitting the $4,400 requested in our letter dated September 4,1984, for Revisions 7 and 3 to the McGuire Nuclear Station pump and valve inservice testing (IST) program and the $150 application fee for Revisions 8 and 4 submitted by the July 25 letter. Your letter stated that the fees were not remitted since the April 20, 1984 and July 25, 1985 submittals contained material to be incorporated into your November 14, 1978 submittal for Unit 1 and your March 31, 1983 submittal for Unit 2.

Your Company further stated that the review of the pump and valve IST program is part of the operating license application, and the fee for its review / approval should be covered by the fee for the operating license applications for the McGuire Station, Unit Nos. 1 and 2. You further stated that since the April 20, 1984 submittal included revisions to an open licensing issue which is currently under review, the $4,400 fee is not appropriate nor is a $150 application fee appropriate for Revisions 8 and 4.

Even though your July 25, 1985 letter stated that the $4,400 fee requested by our September 4,1984 letter was not being remitted, our records show that a payment of $6,400 (Check No. 791478) was transmitted to this office by letter dated February 6, 1985, in payment of the

$4,400 fee for the McGuire Nuclear Station Unit Nos. I and 2 requested by our September 4,1984 letter and in payment of the $2,000 fee for Oconee Nuclear Station Unit Nos.1, 2 and 3 requested by our letter dated September 16, 1984.

The Office of Nuclear Reactor Regulation (0NRR) staff have reassessed their fee position with respect to your Company's submittals on the pump and valve IST program for the McGuire Station, Unit Nos.1 and 2, and agree that the April 20, 1984 submittal provided revisions to your November 14, 1978 submittal for Unit No. 1 and your March 31, 1983 submittal for Unit No. 2. In addition, they have determined that a Class III fee ($4,000) is appropriate for Unit No. 1 because the review will involve consideration of a single safety issue and a Class II fee

($1,200) is appropriate for Unit No. 2 since the review will be adminis-trative in nature in that thesafety evaluation for Unit No. I will also 8701130144 870108 PDR ADOCK 05000369 P PDR

A duplicate fee of $400 for one of the units is not appropriate in this case since the original applications for the two units were not filed concurrently. Since the review of the pump and valve IST program is still pending and the 100% operating licenses have already been issued, the IST program reviews are not deemed to be part of the operating license reviews. Therefore, a sum of $800 remains to be paid to complete the fees for the pump and valve IST program for Unit No. 2.

In addition .our letter dated September 4,1984, informed your Company that we had received Check No. 744686, dated August 7, 1984, in the amount of $150. We requested that you identify the application and facility for which this check is to be applied. Our records do not indicate that we have received a response to our request. Therefore, we are applying the$150 application fee to the $800 due for the pump and valve program. In summary, your Company is requested to remit the remaining sum of $650 to this office.
