Dear Sirs:

1 in a letter dated December 11,1998, you were informed that copies of a proposed rule, that 1 would affect some of your customers, was being distributed to all 10 CFR 31.5 general licensees and, as a result, you may receive inquiries from some of your customers.

As indicated in the December 11,1998, letter, the prg,md rule applies to all 10 CFR 31.5 general licensees. However, as discussed in the Federal Register notice, the U.S. Nuclear Regulatory Commission would only contact, for purposes of registration, approximately 6,000 general licensees, specifically those possessing devices that contain at least 370 MBq (10 mci) of cesium-137,3.7 MBq (0.1 mci) of strontium 90,37 MBq (1 mci) of cobalt-60 or any transuranic (at this time, the only generally licensed devices meeting this criterion contain americium-241 or curium-244).

This letter is being sent to you since our records indicate that you have distributed devices that  ;

would be subject to registration. l On December 15,1998, NRC mailed copies of the Federal Register notice for the proposed I rule to all 10 CFR 31.5 general licensees (approximately 47,000). The names and addresses of these general licensees were originally provided to NRC by vendors as required by 10 CFR 32.52, or Agreement State equivalent regulation. As of March 5,1999, NRC has received more than 8000 pieces of returned mail, of which, more than 800 have been identified as licensees that would be subject to registration. , Currently, an NRC contractor, Oak Ridge National Laboratories (ORNL), is attempting to obtLin the correct mailing addresses for the more than 800 ilcensees that would be subject to registration using other information in the NRC general license database (e.g., telephone numbers) and other sources (e.g., business directories,

Internet).

It is anticipated that ORNL will not be able to locate all of these licensees. In addition, some of ~

these licensees may no longer be in business. Therefore, ORNL may contact you, the original '

vendor of the devices possessed by the licensees, to obtain a more accurate name or address of the licensee, to determine if you have additional information about the status of the licensee, or to determine if you know the status of the licensees's devices (e.g., you received the devices for disposal). ORNL will strive to limit contact with each vendor by providing consolidated listings of multiple licensees, including their devices. ORNL expects to send these letters within the next couple of months.

NRC plans to initiate the proposed registration program for licensees and devices in mid to late 2000. It is anticipated that as part of this initial registration, NRC #11 not be able to obtain the compleie status of the general licensees or their devices without assistance from vendors.

Therefore, NRC plans to invite vendors to participate in a workshop, to be held within the next 6 months, to develop e ; ocess for obtaining assistance from vendors. You will be notified about the details of this workshop in a future letter.
