O HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING JULY 11, 1986 Shoreham The New York State Legislature today passed a bill creating the Long Island Power Authority. The new agency is instructed to begin negotiations with the Long Island Lighting Company concerning a friendly takeover of LILCO at a price of up to $18/ share of LILCO stock.

If LILCO does not accept the offer, the new Power Authority is instructed by the legislation to instigate condemnation proceedings. The legislation also prohibits the agency from constructing or operating a nuclear power plant in its servi'ce. area.

It also prohibits LILCO from recovering any of the cost of Shoreham from the ratepayers if the plant is not in connercial operation by December 1.1988. Governor Cuomo has indicated that he will sign the legislation.

Duane Arnold Energy Center (DAEC)

On June 30, 1986, the Nuclear Regulatory Connission consented to IE Industries, a newly formed holding ccmpany, to become the owner of Iowa Electric Light and Power Company, licensee for the Duane Arnold Energy Center.

Diablo Canyon Court Decision on Spent Fuel Pool Expansion On July 2, 1986, the U.S. Court of Appeals in San Francisco, responding to a motion for a stay by intervenors, issued an order regarding the Diablo Canyon spent fuel pool reracking. The Court ordered that PG&E may proceed, at its own risk, with the reracking of the Unit 1 pool (intervenors had requested a stay) but shall not store any spent fuel in the pool without Court approval. The Court further ordered that PG8E shall not commence with the rerecking of the Unit 2 pool without Court approval. A hearing on this matter will be scheduled for August 1986. PG&E expects to shutdown Unit 1 for the first refueling in late August /early September.

Rancho Seco Nuclear Generating Station Dewey Lowe, the SMUD General Manager, resigned Monday, June 30, 1986. A replacement has not been announced.

On June 30, 1986, the Nuclear Regulatory Commission consented to IE Industries, a newly formed holding company, to become the owner of Iowa Electric Light and Power Company, licensee for the Duane Arnold Energy Center.

Surry Power Station, Units 1 and 2

!#iSS has issued a license under 10 CFR Part 72 which authorizes Virginia Electric and Power Company to store spent fuel from Surry Units 1 and 2 in an independent spent fuel storage installation (ISFSI) on the Surry site using dry metal casks. The license was issued on July 2,1986, and will be in effect for a 20 year period. This is the first license issued by NMSS approving this type of storage facility for spent fuel.

Seabrook Unit 1 i

Two actions described below recently filed with the ASLB regarding i

Seabrook on-site emergency planning and safety issues may impact any timely decision on the safety issues before the Board.

The Seacoast Anti-Pollution League (SAPL) and the State of New Hampshire (NH) were allowed by the ASLB to participate in a contention (NH-10) on the Seabrook Station control room design as Joint JULY 11, 1986 ENCLOSURE B

Intervenors. NH recently filed a motion to withdraw the contention, but SAPL who opposes the motion to withdraw, filed an objection to the withdrawal. Since NH-10 has not been litigated, an ASLB decision in favor of the objection could mean a need to establish a schedule of events for the contention.

Recently, the town of Hampton, New Hampshire, located within the EPZ and admitted as an interested municipality, filed a motion petitioning the Commission to amend its regulations to prohibit issuance of an operating license authorizing low power operations.

In support of its motion, one of the items Hampton cited was the Chernobyl accident as demonstrating the substantial risk of low power testing and the consequent need for adequate and approved off-site evacuation plans even during times of low power testing.

Comanche Peak - Construction Permit Hearing (1) The Board, in a memorandum, ordered Texas Utilities to respond to interrogatories of the intervenor regarding the contention of whether applicants had shown good cause for the granting of a construction pennit extension.

In that order the Board states:

"Unless Applicants rspond to discovery promptly on this side of the case, our only tool for preventing the case from becoming moot will be to suspend the construction license for failure to comply promptly with discovery needs." This side of the case meaning the construction permit extension case as opposed to the licensing case.

(2) The Appeals Board, in a memorandum and order, has decided to certify to the Comission the question of whether the intervenors contention is foreclosed from being litigated in the construction permit extention proceeding by the Commission's decision in WPPSS, CLI-82-29. The Appeals Board also stayed discovery in the construction permit extension proceeding.

Byron 1 Upon cooling down because of an unidentified leakage of 1.007 gpm, Byron 1 noted that the Boron Dilution Protection System (BDPS) was inoperable.

Technical Specifications require that all operations involving positive reactivity changes be suspended with the BDPS inoperable, which would prevent further cooldown. With the conflict in the Tech Specs, the license invoked 10 CFR 50.54(x) at 3:00 CST on July 3, 1986, and continued the cooldown, taking extra precautions to prevent a boron dilution event. The unit is expected to be down 2 to 3 weeks.

Shearon Harris Unit 1 The staff has been infonned that the North Carolina Chatham County Board of Commissioners voted 5 to 0 to continue their support of the Shearon Harris Emergency Preparedness Plan.

Palisades Plant Consumers Power Company (CPCo) has submitted a report dated July 3,1986 to Region III entitled " Final Report - Palisades Plant Material Condition Review Task Force." This report provides the result of the CPCo Task Force review that was required by the Confirmatory Action Letter issued May 21, 1986 by Region III regarding the multiple failures that had occurred after the May 19, 1986 reactor trip. An Augmented Inspection Team, including NRR personnel, had conducted an on-site inspection of the post-trip conditions and found continuing problems with the maintenance activities at Palisades.

The report indicates an extensive review was perfonned on maintenance history

.and involved a detailed investigation of 222 items resulting in approximately 544 corrective action items, 58 percent of which will be taken prior to restart, 29 percent at the 1987 refueling outage, and 13 percent incorporated in their 5-year plan. Best estimate for restart is mid to late September. Region III must approve restart.

Browns Ferry 2 Crack in Recirculation Inlet Nozzle During the period from October to December 1984 (the current outage),

TVA inspected 100% of the accessible stainless steel welds greater than 4" in diameter. TVA also performed induction hearing stress improvement (IHSI) on 100% of the accessible welds and, in accordance with the guidelines in Generic Letter 84-11, reexamined 25% of the stress relieved welds. No indications were found in the recirculation inlet nozzle safe-ends.

As a result of cracks found in other BWRs, TVA is reexamining the 10 recirculation nozzle safe-ends using the Introspect 98 (198) system.

TVA may also examine one or more nozzles with the GE Smart system. On the first nozzle examined (N2A, attached figure), circumferential cracking was found on approximately 93% of the circumference. The maximum crack depth was estimated to be 0.22" in a wall thickness of 1.2" (about 18% thru wall) with most of the crack less than.5%.

In addition, 17 axial cracks were detected, all less than 1" in length and judged to be very shallow. The data for the other nozzles has not yet been analyzed.

TVA is considering replacement of the safe-ends, weld overlay repair or clamping, depending on the extent of cracking in the other nozzles.

The replacement could become the critical path item for startups of Unit 2.

NRC TMI-2 CLEANUP PROJECT DIRECTORATE WEEKLY STATUS REPORT FOR JULY 7 - JULY 13,1986 1.

DEFUELING Core boring activities continued. Core positions N-12 and G-8 were drilled and video examinations of the holes were performed. Core samples from holes at core locations N-5, N-12, and G-8 are currently stored in fuel canisters in the canister positioning system.

Information obtained from core bore operations to date has shown that fuel assemblies N-5 and N-12, which are near the core periphery, are largely intact below the rubble bed.

Fuel assembly G-8, which is nearer to the core center consists largely of a fused mass.

No relocated core material was encountered during drilling from the assemblies' lower end fittings to the lower flow distributor, however, relocated core material was seen in adjacent assemblies during video examinations.

Drilling of core position G-12 is in progress.

PLANT STATUS The reactor remains in long term cold shutdown, vented to the atmosphere. Core cooling is by natural heat loss to ambient building atmosphere. The average incore thermocouple reading is 81 F.

The airborne radioactivity on the defueling platform is about 5.0 E-7 uCi/cc Tritium and 4.6 E-11 uCi/cc particulates, predominately Cesium-137 and Strontium-90. The platform is mounted above the modified internals indexing fixture which is mounted over the reactor vessel. These provide about 15 feet of water over the core region and 6 feet over the carousel holding the defueling canisters.

WASTE MANAGEMENT The Submerged Demineralizer System (SDS) completed processing batch S-134, which consisted of about 14,000 gallons from the neutralizer tank.

EPICOR II completed processing batch 298, 8,500 gallons from the monitor tanks, and batch 299, 7,000 gallons from the monitor tanks.

The system began processing batch 300.

Total volume processed through SDS to date is 4,061,103 gallons, and the total volume processed EPICOR II to date is 3,029,050 gallons.

ENVIRONMENTAL MONITORING US Environmental Protection Agency (EPA) sample analysis results show that TMI site liquid effluents are in accordance with regulatory limits, NRC requirements, and The City of Lancaster Agreement.

The Lancaster water sample taken at the water works river intake and analyzed by EPA consisted of a seven day composite sample taken June 22 - 28, 1986. A gamma scan detected no reactor related activity.

TMI water samples taken by EPA at the plant discharge (includes Units 1 and 2) to the river consisted of seven daily composite samples taken from June 22 - 28, 1986. A gamma scan detected no reactor related activity.

The EPA analysis of the NRC outdoor air sample for the period July 3

- 10, 1986 showed that concentrations of Cs-137 and I-131 were below the lower limit of quantitative detectability for the system.

PUBLIC MEETING The Advisory Panel for the Decontamination of Three Mile Island Unit 2 will meet on August 13, 1986 from 7:00 PM to 10:00 PM at the Lancaster Council Chambers, Public Safety Building, 201 North Duke Street, Lancaster, PA. At the meeting the panel will receive a status report on the progress of defueling from GPU Nuclear and a briefing on the licensee's plans for disposal of the processed water generated from the accident.

Senior Management Meetings (1) The Director, Division of Inspection Programs participated in the public meeting in Gore, OK regarding the restart of the Sequoyah Fuels Facility.

3 (2) The Director, Division of Inspection Programs and other IE Staff participated in two enforcement conferences of Omaha Public Power District and discussed findings during the Ft. Calhoun Safety System Outage Modification Inspection.

Representatives of Arkansas Power & Light Company discussed the findings during the Arkansas Nuclear One Safety System Functional Inspection.

b.

Civil Penalties Paid (1) Georgia Power Company (Hatch) in the amount of $50,000 based on failure to implement adequate compensatory measures following the loss of alarm annunciation capability in central and secondary alarm stations.

(2) Howard University (Cambridge, MA) in the amount of $2,500 based on improper maintenance and transportation of radio-active materials.

Incident Response (1) The Incident Response Branch Chief and staff members attended a meeting with NMSS, SP and ELD to consider an NRC position on the proposed EPA rule requiring reports of releases of radio-nuclides under CERCLA authority.

DOE representatives will also attend. EPA has scheduled a meeting on this proposed rule on July 16.

(2) An Incident Response Branch member attended a meeting of the Subcommittee on Federal Earthquake Response Planning at FEMA to discuss the recent publice. tion of the Federal Plan for Response to Catastrophic Earthquares. The discussion also covered the planning of the next steps in developing regional plans and the exercising of these plants.

d.

Operations Center The Incident Response Branch Chief and staff members met with the Emergency Presponse Data System survey contractor to discuss survey observations to date and how these observations may affect system design and future survey trips.

Emergency Preparedness (1) On July 7, 1986 Chatham County, North Carolina voted to reassume l

their role in emergency planning and response activities in support of Shearon Harris.

4 (2) A member of the Emergency Preparedness Branch attended a meeting of the Training Subcommittee of the Federal Radiological Preparedness Coordinating Committee at Emmitsburg, MD. The meeting agenda included a review of course material developed by the NRC for FEMA emergency training programs.

(3) The Deputy Director, Division of Emergency Preparedness and Engineering Response participated in a meeting with FEMA, EPA, USDA, and HHS to discuss the issues that should be addressed in the emergency planning and preparedness chapter of the post-Chernobyl report.

FEMA hs engaged ANL assistance in this effort.

An initial draft that includes consolidation of current informa-tion will be prepared in the next three weeks with a final chapter being completed in October, which will include the information collected at the August IAEA special meeting.

Safety System Outage Modification Inspections The exit meeting for the Dresden SS0MI is scheduled for July 16, 1986. The team is onsite completing the remaining portions of the inspections, g.

Performance Indicators The Performance Indicator Task Group chaired by the Director, Division of Emergency Preparedness and Engineering Response, met on July 8, 9, 1986.

Principal discussions focused on the implementa-tion of the trial program. All input for the trial program is scheduled to be completed by the end of this month, h.

Quality Assurance (1) A Quality Assurance Branch member participated in the inspec-tion at TERA's offices in Berkeley, CA.

(2) Quality Assurance Branch members attended a meeting in Chatta-nooga, TN to discuss TVA QA topical report, revision 9.

PRA Based Inspection Representatives of the Operating Reactor Programs Branch will be in Region 8 on July 15, 1986 to participate in pre-inspection activi-ties for the upcoming PRA Directed Operational Assessment and Readiness Inspection at Indian Point 2.

International Activities The Deputy Director participated with Inspection Programs staff at the State Department with members of DOE, 00E, FEMA, and EPA regard-ing the upcoming conventions at the IAEA on reporting and assistance for transboundary release and consequences.

ITEMS OF INTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING JULY 11, 1986 U.S.-Federal Republic of Germany Meeting on Cooperation On Thursday a six-member delegation from the Committee for Research and Technology of the Parliament (Bundestag) of the Federal Republic of Germany met with Chairman Zech.

IP Assistant Director for International Cooperation R. Hauber also attended the meeting. The delegation members represented four different political parties. They discussed effects of Chernobyl and our cooperation with FRG agencies in safety information exchanges and safety research programs.

Meeting with Japanese Embassy Representatives on International Terrorism On Friday Mr. T. Sakata and Mr. Senzaki of the Japanese Embassy met with R.

Burnett and other members of the Division of Safeguards and H. Faulkner, IP, to exchange views on the recommendations of the recent report by an International Task Force on Prevention of Nuclear Terrorism. Additionally, J.

Davis, Director, NMSS, spoke briefly with the Japanese visitors about his coming trip to Japan.

International Conventions on Notification and Assistance On Friday S. Schwartz, Deputy Director of IE/DEPER, and R. Senseney, IP, attended an interagency meeting at the Department of State to discuss the proposals for international conventions on notification of nuclear accidents i

with potential transboundary effects and coordination of emergency response and assistance in the event of a nuclear accident. Mr. Schwartz will represent the NRC on the U.S. delegation at a meeting of government experts convened to draft these conventions.

SECY-86-153 - Fitness for Duty of Nuclear Power Plant Personnel - Memo SECY to Stello dated 7/7/86 The Co.mmission (with Chairman Palladino and Commissioners Roberts and Ze'ch agreeing) approved publication of the attached policy statement on Fitness for Duty of Nuclear Power Plant Personnel.

The Federal Register Notice should note that the policy is effective upon publication and that interested members of the public are invited to provide comments.

The staff should provide an analysis of the comments and recommendations to the Commission following receipt of the public comments.

The policy is subject to the continued success of the industry initiatives in implementing fitness for duty programs and the NRC's ability to monitor the effectiveness of those programs.

The Commission will refrain from new rulemaking on fitness for duty for a minimum of 18 months from the effective date of this policy statement and will exercise this deference as long as the industry programs produce the desired results.

Commissioner Asselstine disapproved and provided separate views indicating that he preferred to issue a rule instead of a policy statement.

The additional views of the Commission are also attached.

Commissioner Bernthal approved the policy statement in part and disapproved in part.

He noted that:

" Consistent with the policy statement originally approved by Commissioners Roberts, Zech, and Bernthal, I would have l

preferred that the final policy statement retain the following language.

On page 6, I would delete the phrase,

...in any way related to safety', that was added to the end of the sentence under the second bullet, and I would have retained the original draft wording under the third bullet.

Also on page 6, I would retain the words

... severe disciplinary action, up to and including....', which have been replaced by the word 'possible' in point 1) at the bottom of the page.

On page 7, with the exception of the changes'in point

2) at the top of the page, I would retain the language of the January 29 Commission-approved draft."

The Federal Register Notice should be forwarded for signature and publication.

In addition the Federal Register Notice contained in SECY-85-21A which withdraws the proposed rulemaking on fitness for duty should be revised as necessary and forwarded for signature.

  • Section 201 of the Energy Reorganization Act, 42 U.S.C. 5 5841, provides that action of the Commission shall be determined by a " majority vote of the members present."

Commissioner Roberts was not present when this item was affirmed.

Accordingly, the formal vote of the Commission was 2-1 in favor of the decision.

Commissioner Roberts, however, had previously indicated that he would approve this paper and had he been present he would have affirmed his prior vote.
