SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT N0. 50-313/85-26; 50-368/85-27)

This refers to the inspection conducted on November 4-8, 1985 at Arkansas

l

Nuclear One, Russellville, Arkansas. During this inspection, the NRC identified

l

several security violations. An enforcement conference to discuss these

l

matters was held on December 9, 1985 at the Region IV offices in Arlington.

Texas.

Violation A involved a pathway that potentially provided uncontrolled access

l

from the owner controlled area (OCA) to the protected area (PA). The barrier

l

inside the PA had been secured at one time but was found broken at the time of

l

the inspection and routine surveillance patrols had apparently failed to

j

discover this condition. No record of a surveillance of this barrier could be

l

produced to determine the length of time that access was unsecured. The barriers

outside the PA were unsecured and unlocked.

The violation indicates a weakness

l

in the management oversight and control of that part of the security system

l

designed to ensure that adequate surveillance patrols are performed to identify

such conditions.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1986) Violation A, which is

described in the enclosed Notice, has been classified at a Severity Level III.

Normally, a civil penalty is proposed for a Severity level !!! violation.

However, after consultation with the Director, Office of Inspection and

Enforcement, I have decided that a civil penalty will not be proposed in this

case because of your prior good performance in the security area.

Violations B-E described in the enclosed Notice of Violation are of lesser

signif:cance and are classified as Severity Level IV violations.

plan to prevent recurrence. After reviewing your response to this Notice,

further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.

The material enclosed herewith contains Safeguards Infonnation as defined by

10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited

by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the

material will not be placed in the Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, PL 96-511.
