Appeal from an Initial FOIA Decision, FOIA 85-699
Dear Mr. Stello:
This is an appeal, pursuant to subsection (a)(6) of the Freedom of Information Act as amended (5 U.S.C.
552), of the actual denial of the Commission to release documents requested on October 10, 1985 by the Government Accountability Project regarding Board Notification 85-084 -- ACRS Review of Comanche Peak.SSERs 7 through 11.
By letter dated April 17, 1986 Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us of 14 documents being released to the PDR, and 2 documents being withheld in part pursuant to FOI A Exemptions 5 and 7( A) because they "contain the advice, opinions and recommendations of the staff and information the release of which might interfere with a possible enforcement action."
We believe we are entitled to the release of the withheld portions of documents.
We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to pursue this matter further in the courts.
