i HIGHLIGHTS OF WEEKLY INFORMATION REPORT WEEK ENDING SEPTEM3ER 12, 1986 Perry 1 At about 11:02 AM on Tuesday, September 2,1986, Perry I experienced its first reactor scram involving the insertion of control rods. At the time of the scram, the plant was in the early stages of the nuclear heat up tests.

Reactor power was at about 2% of rated power and reactor pressure was being maintained at about 80 psig by the plant operators.

The reactor scram occurred when the neut;on flux level exceeded the intermediate range monitor trip setpoint. The transient was initiated when a sudden step increase, in the output of the pressure transmitter providing a signal to the "B" pressure regulator, resulted in all seven (7) turbine bypass valves moving to the full open positien. Operating personnel successfully closed the turbine bypass valves by increasing the pressure regulator setpoint above the erroneously sensed pressure. When the valves closed, a slight reactor pressure spike was experienced resulting in a momentary increase in the neutron flux level scraming the reactor. All systems functioned normally fc11owing the scram. The reactor remains shut down pending completion of the licensee's investigation and correction of -

FBI Criminal History Rule The rule package has been revised and is in final approval cycle prior to formal transmittal to CRGR. A summary overview describing the approach, assumptions and impact on NRC cf implementing this program has been prepared i by NMSS, RM and SEC to accompany the rule package.

Access Authorization Policy Statement and Industry Guidelines On September 4,1986, representatives from NUMARC met with SG to review in detail the proposed Access Authorization Policy Statement and the Industry Guidelines. Another meeting was held on Thursday, September 11, 1986, con-tinuing the discussion on Appests, Temporary Clearances, and Grandfathering.

This information is needed in the form of a data base depicting the applicable reporting station, forecasted conditions for specified areas and severe advisories or reports.

ITEMS OF INTEREST Week Ending September 12, 1986 Limerick On August 28, 1986 the Atomic Safety and Licensing Appeal Board issued its decision, ALAB-845, in response to appeals from the Licensing Board's Fourth Partial Initial Decision. The fourth PID, issued on July 22, 1985, concerned the adequacy of the emergency plan for the State Correctional Institute at Graterford (SCIG), Pennsylvania which is within the Limerick EPZ.

The Appeal Board affirmed the Licensing Board's decisions in all but one respect; that concerning the mobilization of the work force at SCIG in the event of a nuclear emergency at Limerick. The Appeal Board remanded this issue to the Licensing Board for further consideration. The Licensing Board has scheduled a hearing for September 25, 1986 on this issue. -The Appeal Board also concluded that this issue does not warrant license suspension pending remedial action.

Diablo Canyon Reinstallation of Original Spent Fuel Racks under 10 CFR 50.59 On September 5, 1986 Region V requested NRR to review the PG&E safety evaluation perfonned according to 10 CFR 50.59 for the reinstallation of the original fuel racks into the Unit I spent fuel pool. NRR staff will discuss

, with PG&E details of the installation in a meeting on Wednesday, September 10, 1986. Originally the racks had been bolted to the spent fuel pool floor using

4 anchors. The bolts had been cut off and the liner surface prepared for the new, high density racks which would be freestanding. The original racks are being reinstalled by welding the feet to embed plates which are welded to the liner.

PG&E started the welding process on September 5,1986 and all original racks are expected to be fully reinstalled by September 19, 1986. As of September 8,1986 the Ninth Circuit Court of Appeals had not issued a final decision regarding intervenors request for a stay of our license amendment authorizing use of the high density racks, pending a hearing on this matter.

Arkansas Nuclear One - Reduction of Work Force as a Result of a Work Force Analysis On September 5,1986' Arkansas Power and Light Company announced that it is reducing its total work force by about 600 positions, an 11% reduction in its current authorized staffing. To date the licensee has identified four nuclear related positions to be eliminated from the plant site (AN0-1&2). These are first level supervisory positions. It is expected that there will be more nuclear related staff and perhaps supervisory positions identified to be eliminated in the near future. This planned reduction is a result of an extensive work force analysis study which considered the completion of the company's long term power plant construction programs, reduced growth rate, new information management tools that have improved productivity and perfonnance, and other internal consolidations and phase-outs. The reductions will include about 15% in supervisory personnel,13% of the general office staff and 11%

in field personnel. We have discussed the planned reductions with the licensee who indicates that the reductions will have no adverse impact on the safe operation of the nuclear plants and will not affect planned improvements.

The license further will formally inform us of their plans.

DIABLO CANYON COURT ORDER CONCERNING SPENT FUEL POOL EXPANSION On September 11, 1986 the U.S. Court of Appeals for the Ninth Circuit issued an Order which concludes:

"The NRC failed to comply with its own regulations in denying petitioners a hearing prior to making the Diablo Canyon reracking license amendments effective. Accordingly, the existing stay of those amendments is continued. PG&E shall not deposit any spent fuel rods in the pool for Unit 1 and shall not rerack the pool for Unit 2 until hearings have been held in compliance with the requirements of the Atemic Energy Act."

The Court further stated that PG&E may elect to return the original racks to the pool in accordance with the existing operating licenses and may use the pools prior to completion of the hearing. PG&E is in the process of

!o. reinstalling the original racks into the Unit 1 pool. The first spent fuel element is expected to be unloaded into the Unit 1 pool on about September 20, 1986. The staff is currently reviewing the PG&E safety evalua-tion performed in accordance with 10 CFR 50.49. No changes have been made to the Unit 2 pool (i.e. original racks remain in place). Unit 2 is expected to enter its first refueling outage in March / April 1987. The ASLB hearing on the spent fuel pool expansion has been scheduled to consnence in March 1987.

NRC TMI-2 CLEANUP PROJECT DIRECTORATE WEEKLY STATUS REPORT FOR SEPTEMBER 8 - 14, 1986

1. DEFUELING

- Defueling activities are currently directed towards removing end fittings from the top of the rubble bed. This will allow more efficient use of the core drilling equipment to perforate the hard crust when it is reinstalled. The end fittings will be temporarily stored in shielded 55 gallon drums in the reactor building until the end fittings can be sized to fit in fuel canisters. The first end fitting was placed into a shielded 55 gallon drum on Saturday evening September 13, 1986.

- In-vessel operations continued to proceed slowly due to poor visibility.

2. PLANT STATUS

- The reactor remains in long term cold shutdown, vented to the atmosphere. Core cooling is by natural heat loss to ambient building atmosphere, average air temperature of 57 F. The average reactor incore thermocouple reading is 78"F.

- The airborne radioactivity on the defueling platform above the reactor-vessel is about 1.7 E-7 uCi/cc tritium and-1.6 E-11 uCi/cc particulates, predominately cesium-137 and strontium-90. About 15 feet of water over the core region and 6 feet over the carousel holding the defueling canisters provide shielding.

3. ENVIRONMENTAL MONITORING

- US Environmental Protection Agency (EPA) sample analysis results show that TMI site liquid effluents are in accordance with regulatory limits, NRC requirements, and The City of Lancaster l Agreement.

l - The Lancaster water sample taken at the water works river intake and analyzed by EPA consisted of a seven day composite sample taken August 24 - 30, 1986. A gamma scan detected no reactor related activity.

l - TMI water samples taken by EPA at the plant discharge (includes Units 1 and 2) to the river consisted of seven daily composite samples taken from August 24 - 30, 1986. A gamma scan detected no

< reactor related activity.

- The EPA analyses of the NRC outdoor air sample for the period September 4 - 11, 1986 showed that concentrations of Cs-137 and I-131 were below the lower limit of quantitative detection (LLD) for the system. The LLD varies around a value of IE-13 uCi/cc.

4. AUXILIARY AND FUEL HANDLING BUILDING ACTIVITIES

- Start-up testing of the sludge transfer system continues.

- Hands-on decontamination has begun in the annulus area between the reactor building and fuel handling building.

- Hands-on decontamination of the "A" Bleed Tank Room and flushing of the Seal Injection Valve Room continues.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending September 12, 1986 Mixed Waste Members of NRC/ EPA management met with Texas State officials concerning their progress towards establishing a LLW facility with a special consideration of the mixed LLW issue. This allowed NRC and EPA to gain an insight as to how a state attempting to develop a new disposal facility views dual regulation of mixed LLW. The State of Texas observed that the dual regulation is workable but it would cause expensive facility design and complex permitting / operation procedures. The absence of EPA's location standards was not a roadblock in siting efforts because the Texas siting guidelines are perceived equal to or more restrictive than EPA's anticipated location standards. EPA committed to provide guidance and consultation to any state or the compact wishing to submit permit application for a new LLW disposal facility.

Harrisburg, Pennsylvania Trip Division of Waste Management staff met with Pennsylvania Bureau of Radiation Protection staff on 9/5/86 to discuss LLRWPAA implementation, NRC approach to development of guidance on requirements for alternative disposal technologies, storage vs. disposal, the Pennsylvania design criteria document. The state expressed interest in early visibility of the NRC review plans. The Bureau staff was generally supportive of the NRC proposal to develop guidance for only two basic alternatives, below grade bunkers and earth mounded concrete bunkers. They support the concept of standardization, and also the continued restriction of storage licenses to 5 year (renewable) periods with added financial and institutional requirements to ensure ultimate disposal.

Continued discussions on the state's design criteria are planned for early October in Silver Spring.

Meeting Concerning West Valley Study On September 4, 1986, FC staff met with a representative of the Aerospace Corporation to discuss comments on the revised draft report entitled, " Case Histories of West Valley Spent Fuel Shipments." Aerospace indicated its intent to complete the final revision of the draft report by September 30, 1986.

Babcock & Wilcox, Apollo, Pennsylvania On September 9,1986, NMSS members met with Babcock & Wilcox (B&W) representatives. Changes in the license to reflect a new organization, cleanup of the Apollo facility, and license renewal of the Apollo facility were discussed.

1. Items of Interest
a. ANS Executive Workshop The Director, IE, two Regional Administrators, and several senior IE and regional managers will participate in the American Nuclear Society Executive Workshop on Utility /NRC Inspection Interface next week.
b. Grand Jury Indictment A Grand Jury indictment was handed down on Septebmer 10, 1986 to American Electric Pcwer Service Corporation, Indiana & Michigan Electric Company, and an individual (currently employed by Consolidated Edison) relative to Appendix R issues at D.C. Cook.
2. The following Significant Enforcement Action was taken during the past week:
a. A Notice of Violation and Proposed Imposition of Civil Penalties was issued to the Tennessee Valley Authority (Browns Ferry) in the amount of $150,000. This action was based on multiple violations involving cable tray supports: inadequate design, inadequate corrective measures, and failures to accomplish activities in accordance with drawings and procedures. b. A Notice of Violation and Proposed Imposition of Civil Penalties was issued to Union Electric Company (Callaway) in the amount of $25,000.

This action was based on two violations; the first involved the inoperability of both trains of the Intermediate Head Safety Inspection while in hot standby and the second included operation in Mode 2 without autostart capability of AFW pumps after Main FW Pumps trip. (EN 86-68)

c. A Notice of Violation and Proposed Imposition of Civil Penalties had been issued to Pathfinder Mines Corporation (Shirley Basin, WY) in October 1985 in the amount of $8,000. This action was based on the apparent unauthorized construction of uranium heap leach piles.

After consideration of the licensee's response and additional informa-tion provided, the staff has decided to fully mitigate the civil penalty to avoid duplication of sanctions imposed by the state and licensee. The licensee has agreed to all other state settlement agreement requirements. (EN 85-73A).

Vora, Division of Engineering Safety RES, represented the U.S. at the IAEA Technical Committee Meeting, held September 1-5, 1986, in Vienna, Austria. The subject of the meeting was " Safety Aspects of Nuclear Plant Aging." The member states who participated were Canada, Czechoslovakia, Finland, France, Federal Republic of Germany, Italy, Pakistan, Sweden, Switzerland, U.K., U.S. A., and Yugoslavia. The Nuclear Energy Agency of the Organization for Economic Development (0 ECD) also participated.

4 l Presentations and discussions of technical issues included (a) genera'. afety

aspects of NPP aging, (b) monitoring of aged equipment, (c) inservice inspection, (d) preventive maintenarce, and (d) data collection. Also, the various options for international ctoperation in managing plant aging and IAEA's role in coordinating such cooperation were discussed.

The committee continued its work, begun last year, in developing a state-of-the-art report on the safety aspects of NPP Aging. The revised draft has been scheduled for completion by June 1987. It will then be discussed at the International Symposium on Safety Aspects of the Aging and Maintenance of Nuclear Power Plants, June 29-July 3, 1987, Vienna, Austria.  ;

RES RULEMAKING ACTIVITIES Consideration of Earthquakes in the Context of Emergency Preparedness (Part 50)

On December 8, 1981, the Commission ruled in a then-pending adjudication that its emergency planning regulations do not require consideration of potential earthquake effects on emergency plans for nuclear power reactors. In the Matter of Southern California Edison Com)any, et al. (San Onofre Nuclear GeneratingStation, Units 2and3),CLI-31-33,14NRC1091(1981). The Commission affirmed this position in the Diablo Canyon proceeding. In the Matter of Pacific Gas and Electric Company (Diablo Canyon Nuclear Power Plant, Units 1 and 2). In this decision, the Commission stated that it would initiate a rulemaking "to address whether the potential for seismic impacts on emergency planning is a significant enough concern for large portions of the nation to warrant the amendment of the regulations to specifically consider those impacts."

A proposed rule was published in the Federal Register on December 21, 1984.

The proposed rule states that neither emergency response plans nor evacuation time analyses need consider the impact of earthquakes. On August 21, 1985, the EDO submitted for Commission consideration a final rule which would require limited consideration of earthquakes in emergency planning.

On April 25, 1986, the D.C. Court of Appeals agreed with~ the Commission's San Onofre finding that emergency plans need not consider the effects of i earthquakes. The Commission then approved an 0GC suggestion to withdraw the l proposed rule and let the court decision stand alone. 0GC has submitted to the Commission (9/10/86) for approval a Federal Register notice that would accomplish this.

l I Deletion of the Unusual Event Emergency Classification (Part 50)

In late 1984, the Office of Inspection and Enforcement requested the Office of Nuclear Regulatory Research to initiate a rulemaking to delete the unusual event emergency classification. This request was made because: (1) unusual events are not emergencies; (2) they usually do not affect the public health and safety; and (3) they are usually handled and resolved by plant personnel.

Additionally, the notification of these events not only drains NRC resources but may tend to desensitize State and local governments. After a rulemaking l package was drafted, inquiries to FEMA and the AIF indicated that many State j governments were opposed to deleting the notification of these events.

As a result, IE submitted a memo to RES (E. Jordan to K. Goller, dated August 22,1986) requesting that this rulemaking be suspended pending the

! outcome of a complete review of emergency planning regulations. RES concurs i

and will recommend termination of this action.

3 Rule to Amend the Transportation Provisions Pertaining to the Shipment of Low Specific Activity (LSA) Material (Part 71)

The concept of requiring lesser packaging for low specific activity (LSA) radioactive material has been expanded to the extent that a limit must be placed on package content to control external radiation levels in the event of loss of package shielding in a severe accident. IAEA has imposed such a limit and NRC staff proposes to adopt the same limit. The rulemaking to accomplish this has been complicated by the decision to concurrently impose another limit on LSA shipments, this one to control the economic aspects of LSA accidents, including the prolonged closing of major highways. In the absence of earlier standards development work regarding economic aspects, NMSS asked D0T to arrange for a study of both safety and economic aspects of LSA shipments.

Delays in completing this study by the Department of Transportation have caused a delay in the development of the regulatory analysis and proposed rule. The D0T contractor had projected September 30, 1986, for task completion; but it is now apparent that the research will require another 6 months or more to complete. Consideration is being given to suspending this rulemaking until the D0T study is completed and agreement is reached on what the LSA rule should accomplish.

accompanied by Dr. Rudolf Goertz, consultant to BMU, visited NRC for discussions on plant decomissioning and nuclear electromagnetic pulse effects on plant operation. NRR, RES and IE staff participated in these discussions. On Friday the visitors traveled to TMI to speak with Bill Travers on the ongoing cleanup operations at TMI. Hans Schechter, IP, accompanied the visitors to TMI.

On Tuesday a six-member nuclear delegation from Argentina headed by Alberto Costantini, President of the Argentine National Atomic Energy Comission (CNEA), met with Commissioner Asselstine, J. Shea and K. Henderson of IP, D. Ross and J. Cortez of RES, and R. Cunningham of NMSS to discuss general nuclear safety topics, including a draft NRC/CNEA Technical Information Exchange and Cooperation Arrangement, which is in the final stages of negotiation. The delegation came to NRC following one and a half days of meetings with Ambassador Kennedy and other State Department officials. They met again on Friday with RES and IP to continue discussions on the proposed arrangement.

. Companies made a courtesy call on Chairman Zech and met with E00 Stello and other NRC senior staff members. R. Hauber and H. Faulkner of IP also met with the group.

OFFICE OF STATE PROGRAMS ITEMS OF INTEREST WEEK ENDING SEPTEMBER 12, 1986 Hazardous Materials Transportation Steve Salomon, OSP, attended a workshop, " Towns at Risk: Hazardous liaterials Transportation," sponsored by the National Association of Towns and Townships, at its annual educational conference at the Sheraton Washington Hotel on September 5, 1986. Topics included accident prevention, emergency response, research and planning and the role of a local elected official. One of the main stumbling blocks to effective programs was identified as information dissemination to the local level of government in view of the vast amount of technical information available.

Southeast Low-Level Waste Compact The Board of the Southeast Low-Level Waste Compact met in Atlanta on September 10 and 11,1986. They considered additional technical information

regarding selection of the next host State. The Board voted 14-2 to select North Carolina as the next host.

.- The New Mexico radiation control program will be reviewed the week of September 22, 1986.

Training Course During the week of September 22-26, 1986, twenty-one State radiation control personnel and one person each from the Navy and Air Force will attend the course entitled " Introduction to Licensing Practices and Procedures" in Bethesda.
