DPR-63 Gentlemen

l Niagara Mohawk Power Corporation (NMPC) hereby transmits an Application for Amendment to the Nine Mile Point Unit 1 (NMP1) Technical Specifications (TSs) as set l forth in Appendix A of Operating License DPR-63. The proposed changes to the TSs are l enclosed as Attachment A to this application. The supporting information and analysis pursuant to 10 CFR 50.92 which demonstrate.that the proposed changes do not involve a significant hazards consideration are included as Attachment B. The basis for concluding that this application meets the criteria of 10 CFR 51.22 for categorical exclusion from performing an environmental assessment is included as Attachment C. Also, to assist the NRC Staff with their review, hand mark-up copies of the current TS pages are provided as Attachment D.

l The proposed changes to the TSs contained herein revise Sections 3.6.14 and 4.6.14, l " Radioactive Effluent Instrumentation," and Section 4.6.15, " Radioactive Effluents."

l Specifically, the proposed changes modify the Footnote for TS Table 3.6.14-2 and Note for Table 4.6.14-2 to make the application of the Emergency Condenser Vent Noble Gas Activity Monitor channel operability requirement and daily sensor check Surveillance Requirement (SR) consistent with the conditions specified in Limiting Condition for Operation (LCO) 3.1.3.a for operability of the Emergency Cooling System (ECS). At least

one Nable Gas Activity Monitor in each of the two ECS loop common atmospheric vent L lines is required to be operable to provide assurance that the radiological dose rates for the

gaseous effluents specified in LCO 3.6.15.b.1 are not exceeded. The proposed changes also correct a clerical error in TS SR 4.6.15.d. No changes to the TS Bases are required.

Pursuant to 10 CFR 50.91(b)(1), NMPC has provided a copy of this license amendment application and the associated analysis regarding no significant hazards consideration to the appropriate state representative.
