AFFIDAVIT OR ROBERT A. BACKUS 1.
My name is Robert A. Backus.
I am counsel for the Seacoast Anti-Pollution League (SAPL).

On April 14, I called the Clerk of the U.S. Bankruptcy Court for the District of New Hampshire, Mr. Tim Smith, and was informed that the party signing the letter of agreement for Omne Mall, Omne Partners II, is in bankruptcy.
The bankruptcy has been converted from a Chapter 11 proceeding to a Chapter 7 proceeding.
The trustee is one Leonard Deming.

The letter of agreement signed on behalf of Omne Partners II is of no current validity since control of the property would now be vested in the trustee in bankruptcy, or possibly, according to Mr. Smith, a mortgagee bank, since relief from the bankruptcy stay may be granted by the court to proceed with foreclosure.
