Gentlemen:

This refers to the inspection conducted by Messrs. M. E. Murphy and

R. E. Ireland of this office, Mr. D. J. Kubicki of the Office of Nuclear

Roattor Regulation, Mr. C. 8. Ramsey of Region V, and Mr. K. Sullivan of the

Brcokhaven National Laboratory during the period September 26-30,1988, of

activitfes authorized by NRC Operating License ORP-34 for the Fort St. Vrain

Nuclear benerating Station, and to the discussion of our findings with you and

members of g ur staff at the conclusion of the inspection.

Areas examined during the inspection included implementation of and compliance

to the safe shutdown requirements of 10 CFR 50, Appendix R.

Within these

areas, the inspection consisted of selective examination of procedures and

representative records, interviews with personnel, and observations by the NRC

inspectors. The inspection findings are documented in the enclosed inspection

report.

During this inspection, it was found that certain of your activities were in

violation of NRC requirements.

Consequently, you are required to respond to

this violation, in writing, in accordance with the provisions of Section 2.201

of the NRC's "Rules of Practice," Part 2, Title 10, Code of Federal

Regulations.

Your response should be based on the specifics contained in the

Notice of Violation enclosed with this letter.

Also during this inspection, it was found that certain of your sctivities

appeared to deviate from commitments made to the NRC. These items and

references to the comitments are identified in the enclosed Notice of

Deviation. You are requested to respond to these deviations in writing.

Your

response should be based on the specifics contained in the Notice of Deviation

enclosed with this letter.

One unresolved item is identified in paragraph 7.a.2 of the enclosed inspection

report.

We have also examined actions you have taken with regard to previously

identified inspection findings.

The status of these items is identified in

paragraph 2 of the enclosed report.
