,R,E,L,AT,ED TR,AKEN_DM,E,N,T N0.130, TO PROVISIONAL OPERATING LICENSE NO DPR-16 GPU h0 CLEAR CORPORATION AND JERSET tlMM7%lhTUlthTTORPANY OMTER CREEK NUCLEAR GENERATING _ STAT!_0N DOCKET N0 d o,,2j9 INTRODUCTION By letter dated Septerbe? 28, 1908, GPU Nuclear Corporation (GPUN/ licensee) requested an anendnent to Provisional Operating License No. CPR-16 for the Cyster Creek Nuciear Generating Station (Oyster Creek). The requested change to Apper. dix A of the operating license would allow removing the high pressure scram function when the reactor vessel head ic recoved or unbolted. This change is necessary to install new analog pressure sensors during the 12R refuelirs cutage. The arendrent would revise the Cyster Creek Technical Specifications Table 3.1.1 by adding a reference note "11" in the startup rode for the high reactor pressure scram function, which would state:

EVALUATI,0,N The licensee's preposed Technical Specification Change Request (TSCR) Nc. 174 wculd allow reroving high pressure scram function when the reactor vessel head is removed or unbolted. This change is necessary to install new analog pressure sensors during the 12R refueling outage.

When the reactor taperature is less than 212'F and either the reactor vessel tead is reroved or unbolted, there is no possibility of a r.ajor reactor pressure excursion. Since a major reactor pressure excursion is not possible, the instro-sentation required to scram the reactor in response to an excursion serves no purpose. Additionally, the Boiling Water Reactor Standard Technical Specifica-tions specifically state that the high pressure scram function is not required when the pressure vessel head is unbolted or reroved in the STARTUP mode.

This request more closely aligns the Oyster Creek Nuclear Generating Station Technical Specifications with the Boiling Water Reactor Standard Technical Specificatters.

On this basis, we have detertined that above changes to Table 3.1.1 of the Oyster Creek Technical Specifications are acceptable.

ENVIRONMENTAL CONSIDERATION This amendment changes a requirement with respect to the installation or use of a facility componer.t located within the restricted area as defined in 10 CFR Part 20. The staff has determined that the amendment involves no

significant increase in the amounts, and no significant change in the types, L

of any effluents that ray be released offsite, and that there is no sigr.if-i icant increase in indi ridual or cumulative occupations) radiation exposure.

l The Commission has preciously issued a proposed finding that this amendment involves no significant hazards consideration and there has been no public comment on such finding. Accordingly, the amendment meets the eli criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9)gibility Pursuant t

to 10 CFR 51.22(b), no environmental impact s'stement or environmental assessment need be prepared in connection with the issuance of this amendment.
