ATTEMPTS TO INTERVIEW POTENTIAL COMANCHE PEAK ALLEGER J0E MACKTAL In response to a January 23, 1986, Ft. Worth Star Telegraph newspaper article entitled " Comanche Peak Examining Ex-Foreman's Allegations" (Enclosure 1), I attempted to contact the former Brown & Root employee, Joe Macktal, mentioned in the article. The article said that Macktal reported " serious safety deficiencies in electrical work" at Comanche Peak.
I contacted Macktal at his residence and he stated that his lawyer was documenting his concerns regarding Comanche Peak. Macktal stated that his lawyer had directed him to refer all NRC inquiries to her. Macktal subsequently identified his lawyer as Billie Garde.
On January 24, 1986, I contacted Billie Garde and she stated that she was not yet prepared to present her witness (Macktal) to the NRC for questioning.
On January 31, 1986, I recontacted Ms. Garde regarding the proposed meeting between Macktal and Region IV personnel. Ms. Garde stated she had conversed with Vince Noonan who had informed her that Region IV would be taking the initiative to interview Macktal.
Ms. Garde stated that if the NRC insisted on the Region IV interview of her witness she would not allow her witness to testify to the NRC. Ms. Garde said she was sending a letter to the NRC Commission this date and forwarding a copy to Region IV regarding her objections of NRC's handling of this matter.
Ms. Garde stated that until the release of the OIA report regarding the Comanche Peak "T-shirt incident" and subsequent corrective action that she would not allow "whistleblowers" to report concerns to Region IV. Ms. Garde said she was unaware if reforms had been effected within Region IV to correct "long-term problems" within the Region. Ms. Garde did not further explain or identify her statement with regard to Region IV.
Ms. Garde stated until she received word from the NRC Comission that she would put her "whistleblowers on hold" and the telephone conversation was terminated.
I contacted Mr. Macktal approximately thirty minutes after my second conversation with Ms. Garde. Mr. Macktal stated he had " retained Ms. Garde as my counsel" and would concur with her judgement.
