PROPOSED SECTION 274 AGREEMENT WITH ILLINDIS Enclosed for your signature is a negative consent paper requesting Comission approval for publication for public coment of a Federal Register notice of a proposed Section 274 Agreement with Illinois (enclosure 1),

We do not nonna11y request Comission approval for this action (we do t

request Comission approval of staff recommendations for final action on such requests followina analysis and consideration of public coments).

Comission approval is sought in this case because of questions relating to the possible need for continued NRC regulation of the Allied Chemical plant because 'of its importance to the comon defense and security of the U.S.

DOE's written views on this aspect are furnished with the paper as are those of the Director of the Illinois Department of Nuclear Safety. The Federal Register notice notes that the Comission is considering whether continued NRC regulation of the Allied Chemical plant is necessary in the interest of corrion defense and security and has not decided whether or not to relinquish authority to the State.

As decided in the meeting with you on November 28, 1986, OSP is taking the lead in developing a Commission action paper for detemining NRC policy for regulation (Agreement State vs NRC) of facilities that have significant comon defense and security considerations, such as the Allied Chemical UF conversion plant.

6 Following consideration and analyses of public coments and Comission decision on the policy paper, we will recommend Casumission action on the Illinois request for agreement.

NMSS and OGC concur in the negative consent paper.

Dear Mr. Chairman:

By this letter I request establishment of an Agreement between the U.S.

Nuclear Regulatory Commission (NRC) and the State of Illinois, as authorized under Section 274b of the Atomic Energy Act of 1954, as amended, under which the NRC will discontinue and the State of Illinois will assume certain regulatory authority for radioactive materials now under Federal jurisdiction.

I an authorized by the Illinois Radiation Protection Act (Ill.

Rev. Stat.

1983, ch.

111 1/2, par. 216b) and the Illinois Low-Level Radioactive Waste Management Act (1984 Supp. to 111. Rev. Stat.1983, ch.111 1/2, par. 241-19) to enter into such an Agreement with NRC.

The specific 1

regulatory authority requested at this time is for:

i a.

Byproduct material as defined in Section 11e(1) of the Atomic Energy Act of 1954, as amended; b.

Source materials; c.

Special nuclear materials in quantities not sufficient to form a l

critical mass; and, d.

Land disposal of source, byproduct and special nuclear material received from other persons.

l 1 certify that the State of Illinois has a program for the control of radiation hazards adequate to protect the public health and safety with respect to the materials within the State covered by the proposed agreement, i

l and that the State desires to assume regulatory responsibility for such materials.
