McGuire Nuclear Station Docket No. 50-369 and 50-370 Generic Letter 85-09 Technical Specifications Reactor Trip Bypass Breakers Gentlemen:

By letter dated December 7,1985, Duke Power Company submitted proposed changes to McGuire's Technical Specifications, pursuant to Generic Letter 85-09, pertaining to Reactor Trip System Instrumentation and Surveillance. Requirements.

The NRC Staff, by letter dated June 10, 1986, responded that the submittal.was unaccep-table because of Duke's position that testing of Reactor Trip Bypass Breakers (BTBs) should not be included in Technical Specifications. The Staff does not agree with this position, and is withholding approval of the entire submittal.

By letter dated November 7,1986, the NRC again reiterated its position that surveillance requirements for the bypass breakers must be included in technical specifications.

Duke continues to believe that BTBs surveillance need not be included in Technical Specifications. The only apparent reason for inclusion of BTBs surveillance in the Technical Specifications is to provide added assurance that maintenance is performed on the breakers; no Action Statements or Limiting Condition for Oper-scion (LCO) were proposed -in GL 85-09.

The use of Technical Specifications solely to require surveillance is contrary to industry efforts to optimize the content of.

Technical Specifications. However, in the interest of an expedient resolution to the outstanding items lof Generic Letters 83-28 and 85-09, Duke agrees to include BTBs in Technical Specifications. The changes are included in Attachment I.

Also included in Attachment I is a proposed Basis for the Specification, which discusses "why" the BTB surveillances are Technical Specifications.

Document Control Desk March 16, 1987 Page 2 The Bases, while not a part of Technical Specifications, serve to document the purpose and logic considered in the development of the Specifications. Bases for BTBs were not included in GL 85-09.

Attachment II presents a Safety Analysis and No Significant Hazards Consideration analysis.

The changes proposed in this submittal are in addition to, and do not affect, those proposed in the December 7,1985 submittal.
