Your letter cated April 18, 1985 Thank you for the thought-provoking questions raised in your letter to me dated April 18, 1985. With respect to the questions you raised, the following references should assist you in understanding our bases for the citation:
1.
Definition of " spent fuel" - 10 CFR 72.3(v) and 10 CFR 140.91, Appendix A, III.
2.
In the view of the NRC, the term " sealed form" applies to the material in question. However, since possession of the spent fuel in either "any form or sealed form" was not specifically authorized by the license, possession of such material would be a violation.
3.
The special nuclear material license in effect at the time of the violation was a specific license (not a broad license) which did not authorize the receipt, use or storage of spent fuel, or the byproduct material contained therein. Conversely, the byproduct material license did not authorize possession of the special nuclear. material contained in the spent fuel samples.
Further, the broad license that was issued to NBS subsequent to the citation authorized storage only (not use) of the spent fuel in questior., and 4 citation would have been issued due to the use of the material, even if the broad li\\ense had been in effect.
As you are aware, subsequent to being infonned of the violatio, the National Bureau of Standards requestt1 an amendment to License No. SNM-362.
1 Authorization to store the spent fuel was issued February 5,1985 and subsequently incorporated into the renewal / consolidation of the facility license on May 27, 1985.
