The Franklin Regional Council of Governments (FRCOG) has reviewed the Brief filed by the Licensee and findt that all of their arguments are without merit and that the Atomic Safety and Licensing Board ( ASL B) acted properly within its discretion and within the bounds of reguhtion and case law in issuing its prehearing conference order.

The FRCOG requests the Commission deny this Appeal uphoid LBP 99-!4 and that the proceeding before the ASLB should proceed e.xpeditiously.
