SUBJECT: NOTIFICATION OF CESSATION OF LICENSED ACTIVITIES
By letter dated February 9,1999, you informed NRC of your intent to cease licensed activities
and terminate your Radioactive Materials License No. 50-29001-01. The NRC has specific ,
requirements as specified in 10 CFR 30.36 for decommissioning facilities and for terminating i
licenses. The iriformatior: outlined below may be helpfulin understanding these requirements.
Licensees that used only sealed sources, and the most recent leak test demonstrates that the
sources did not leak while in the licensee's possession (i.e., if ieak test results have been
<0.005 pCl); or used relatively short-lived radioactive material (i.e., T% s 60 days) in an
unsealed form and the maximum activity authorized under the license has decayed to less than
the quantity specified in 10 CFR Part 20, Appendix C should:
1. Demonstrate to NRC that the sources never leaked, both while in your custody and
upon arriva! at the ultimate destination (i.e., by leak test records) or that the maximum
activity of radioactive material authorized under your license has decayed to less than
the quantity specified in 10 CFR Part 20, Appendix C;
f.. Dispose of or transfer the licensed materialin accordance with NRC requirements;
3. Transfer the records discussed in 10 CFR Parts 30.35,30.36, and 30.51 to the NRC
Region IV office; and
4. Submit an NRC Form 314 " Certificate of Disposition of Materials" to NRC.
If you possessed and used only sealed sources, but cannot demonstrate tnat the sources did
not leak while ir. your possession (i.e., leak tests are not available or indicate contamination
>0.005 pCi); or possessed unsealed radioactive material with T% s 60 days but the maximum
activity authori:ad under the license had not decayed to less than the quantity specified in 10
CFR Part 20, Appendix C; or possessed unsealed radioactive material with T% > 60 days but s
120 days you should:
1. Determine the extem of contamination at your facility;
2. Remove residual radioactive material to levels that would permit release of the facility;
3. Dispose of the licensed material in accordance with NRC requirements, usually by
returning sealed sources to the manufacturer or disposing of licensed material as
outlined in the NRC regulations;

4. Detennine the radiological status of your facility and pedorm further remediation, if
necessary to meet NRC's criteria (See Enclosure 4 for a description of the surveys that
should be performed for licensees meeting the criteria discussed above).
5. Submit the results of a survey of your facility demonstrating that residual radioactive
material levels m9et the NRC's criteria for unrestricted use or demor,s! te that your
facility, or portica of the facility, meets NRC's criteria for unrestricted use to NRC by
some other means;
6. Transfer the rccords discussed in 10 CFR Parts 30.35,30.36, and 30.51 to the NRv,
Region IV office; and
7. Submit an NRC Form 314 " Certificate of Disposition of Materials" to NRC.
8. Please note ti. . .f leak test resu!ts indicate a presence of 0.005 pCi or more of
removable contamination, you must file a report with NRC in accordance with 10 CFR
30.50(b)(2) and your license conditions.

Dear Dr. Prange,
The Molecular Ecology Lab of the U.S. Geological Survey, Biological Resources Division, seeks
information about the decommissioning of radioactive materials and termination of our materials
license. We are currently in the process of phasing out our use of a "S, a 32P, and y 32P isotopes
in exchange for a nonradioactive genotype detection system. Our current materials license (No.
50-29001-01) was renewed in November of 1998 and expires 31 October,2004. We anticipate
using a-32P and y-32P isotopes during the next few months, but feel that use will cease by
,
November of 1999. j
Our bureau Radiation Safety Officer informed me that there are several forms (e.g., Timeliness
Rule for Decommissioning, NUREG/CR-5849, NUREG/BR-0241, and NRC form 314) and final
. procedures we must follow for decommissioning. I would be grateful if you could forward these
documents and other appropriate information to me. Also, I assume that we must maintain an
active license after we cease to use, but continue to store decaying isotopes mentioned above?
