McGUIRE NUCLEAR STATION RESPONSE TO VIOLATION 50-369/87-01-01 and 50-370/87-01-01 10CFR 20.201(b), requires a licensee to perform such surveys as may be necessary to demonstrate compliance with 10CFR 20.106 which limits the release of radio-activity in unrestricted areas to the concentrations in Appendix B, Table II and are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present.
Technical Specification 6.8.1.a requires that written procedures be established, implemented, and maintained covering the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 28.
Appendix A cpeci-fies that wrirten laboratory procedures should be implemented to determine con-centration anu species of radioactivity in liquids and gases prior to release, including representative sampling, validity of calibration techniques, and ade-quacy of analyses.
McGuire Nuclear Station (MNS) Technical Specification Table 4.11-1 requires Fe-55 analyses of selected radioactive liquid wastes discharged from the McGuire facil-ity.
Contrary to the above, vendor procedures for low level Fe-55 concentration analy-ses utilized inadequate background estimate methodology resulting in inaccurate effluent release radionuclide measurements.
RESPONSE

Admission or denial of violation:
Duke admits the violation.

Reason for the violation if admitted:
The analysis was performed by a vendor laboratory that was unable to con-tinually meet the necessary accuracy criteria.
3.
Corrective steps which have been taken and the results achieved:
Another vendor laboratory has been evaluated and has satisfactorily met Quality Assurance, technical review, and blind cross check requirements.
This change in vendor laboratories was made March 10, 1987 until inhouse or other superior arrangements can be made.
4.
Corrective steps planned to avoid further violations:
As a continuing check on the acceptability of the new vendor's analysis for Fe-55, quarterly blind cross checks will be sent to the vendor by one of the nuclear stations. Ine acceptability (or non-acceptability) of the results of the blind cross checks and all future NRC confirmatory measurements samples will be communicated to the vendor in a timely manner so that any trends or unacceptable results may be immediately investigated.
