NOTICE OF VIOLATION Virginia Electric and Power Company Docket Nos. 50-338 and 50-339

' North Anna Power Station License Nos. NPF-4 and NPF-7 EA 86-76 During a Nuclear Regulatory Commission (NRC) inspection' conducted on March 17-21, 1986, violations of NRC requirements were identified. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1986), the violations are set forth below:

A. 10 CFR 71.5 requires'that licensees who transport licensed material outside the confines of their plants or other place of use, or who deliver licensed material to a carrier for transport, shall comply with the applicable requirements of the regulations appropriate to the mode o' transport of the Department of Transportation in 49 CFR Parts 170 through 189.

49 CFR 173.441(a) states that except'as provided in 49 CFR 173.441(b), each package of radioactive materials offered for transportation shall be <

designated and prepared for shipment so that under conditions normally incident to transportation, the radiation level does not exceed 200 millirem per hour at any point on the external surface of the package.

Contrary to the above, on March 5,1986, radioactive materials shipment No. 86-RMS-14 arrived at Chem-Nuclear's Barnwell, SC facility with dose rates in excess of 200 millirem per hour on the lower external surface of the package. The exceptions provided by 49 CFR 173.441(b) did not apply. i s@

B. 10 CFR 20.201(b) specifies that each licensee shall make or cause to be made such surveys as may be necessary for the licensee to comply with the regulations and are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present.

10 CFR 20.201(a) defines survey to mean an evaluation of the radiation hazards incident to the production, use, release, disposal, or presence of radioactive material or other source of radiation under a specific set of conditions.

Contrary to the above, the licensee failed to adequately evaluate the extent of radiation hazards from February 26, 1986, to March 24, 1986, in that the licensee failed to perform beta radiation measurements necessary to evaluate the beta radiation levels in steam generators "A" and "C" prior to allowing maintenance activities to begin in the steam generators.

This is a Severity Level IV violation (Supplement IV).

Virginia Electric and Power Company AUG 081986 The second violation in the enclosed Notice concerns your failure to evaluate the beta radiation levels in steam generators prior to allowing maintenance activities to begin. This has been categorized as a Severity Level IV violation.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosures will be placed in the NRC's Public Document Room.
