Gentlemen:

SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-338/86-07 AND 50-339/86-07)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted on

March 17-21, 1986, at the North Anna Power Station, Mineral, Virginia.

This

inspection included a review of the circumstances surrounding the shipment of a

used demineralizer vessel with dose rates on the external surface of the package

in excess of regulatory limits.

This inspection verified the events and circum-

stances as previously reported by the licensee, and accordingly, an Enforcement

Conference was held in the Region II Office on April 9, 1986, to discuss this

matter.

vessel was 200 millirem per hour but that the geometry of the measurement was

poor. Upon arrival at its destination 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> later, dose rates were found to

be in excess of 200 millirem per hour by the recipient which was later confirmed

by members of your own staff.

You stated at the Enforcement Conference that the

cause-of this event was the survey technique used and supervisory judgmental

error in shipping a package that had radiation levels at the regulatory limit.

In accordance with the " General Statem'ent of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the first violation

described in the enclosed Notice has been classified as a Severity Level III

violation.

Normally, a civil penalty is considered for a Severity Level III

!

violation.

However, after consultation with the Director, Office of Inspcction

,

and Enforcement, I have decided that a civil penalty will not be proposed $r. this

Notice of Violation

Pursuant to the provisions of 10'CFR 2.201, Virginia Electric and Power Company

is hereby required to submit to this office within 30 days of the date of the

letter transmitting this Notice a written statement or explanation in reply

including for each alleged violation:

(1) the reason for the violation if admitted,

(2) the corrective steps that have been taken and the results achieved, (3) the

corrective steps which will be taken to avoid further violations, and (4) the

date when full compliance will be achieved. Where good cause is shown,

consideration will be given to extending the response time.
