This is the final response to your [[letter::05000413/LER-1984-006-02, :on 840806,boron Sampling from Nonoperational Train B of RHR Nd Sys Did Not Provide Representative Sample of Boron Concentration of Reactor Coolant.Caused by Personnel Error.Sampling Valves Realigned|letter dated September 5,1984]], in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of documents pertaining to four categories of information regarding Notices of Violation at the Catawba plant.

The documents listed on the enclosed Appendix L and portions of the documents listed on the enclosed Appendix M are responsive to your request and are being placed in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555. You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting PDR folder F01A-84-722 under your name.

Additional records related to your request have been identified in responses to previous F0IA requests. These responses are maintained in the PDR in folders F01A-83-200 and F01A-84-48 both under the name of Garde. You may obtain copies of those records by referring to the above F0IA folders.

Portions of the documents listed on Appendix M are being withheld from public disclosure pursuant to Exemption (7)(D). The information withheld consists of the names of individuals and personal identifiers. Because disclosure of this information would reveal the identities of confidential sources, it is being withheld from public disclosure pursuant to Exemption (7)(D) of the FOIA (5 U.S.C. 552(b)(7)(D)) and 10 CFR 9.5(a)(7)(iv) of the Consnission's regulations.

Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been detennined that the infonnation withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Dr. J. Nelson Grace, Regional Administrator, Region II.

Dear Mr. Felton:

Pursuant to the Freedom of Information Act, 5 U.S.C. 522, as amended, the Nuclear Information and Resource Service requests the following documents regarding a Notice of Violation at the Catawba plant.

Please consider " documents" to include reports, studies, test results, correspondence, memoranda, meeting notes, meeting minutes, working papers, graphs, charts, diagrams, notes and summaries of conversations and interviews, computer records, and any other forms of written communication, including internal NRC Staff memoranda.

In your resoonse. olease identify which documents corresoond to which reouests below.

Pursuant to this request, please provide all documents prepared or utilized by, in the possession of, or routed through the NRC related to:

1. The Notices of Violation 84-88-01 and 84-39-01 (associated with Inspection Reports 50-413-84-88 and 50-414-84-39, respectively), concerning " Inadequate Implementation of Quality Assurance Requirements in the Welding Program";
2. All " raw data" (g g. telephone interviews, affidavits, notes),

studies, and analyses done by Duke Power Company, the Brookhaven National Laboratory, and other consultants relating to investigation (s) by Duke Power Company in connection with the

" Welder B" issue, and the above-referenced Notices of Violation;

3. All " raw data", studies and analyses done by or for the NRC Staff (or its consultants) for the NRC Staff's investigation'of the " Welder B" issue and the above-referenced Notices of Violation; and
4. The NRC Staff review of the Duke Power investigation and documents related to the investigation.

, In our opinion, it is appropriate in this case for you to waive search charges, pursuant to 5 U.S.C. 552(a)(4)(A) "because furnishing the information can be considered as primarily benefiting the general public."

The Nuclear Information and Resource Service is a non-profit organization serving local organizations concerned about nuclear power and providing infor-mation to the general public.

Information required by 10 CFR 9.14a was provided by letter dated August 3, 1984 The documents requested by this letter will be used by the intervenors, the Palmetto Alliance, in the Catawba operating license proceeding.

Insofar as the information can lead to a full and public airing of issues related to public safety, in an ajudicatory proceeding, the release of such documents will benefit the public living near and around the Catawba plant.

I look forward to a response within the ten working days allowed by law.
