ISSUANCE OF AMENDMENT NO.1 TO SNM-2001 (TAC L50118) 4
Dear Mr. Rosenthal:
I am responding to your letter dated July 9,1998, requesting that the U.S. Nuclear Regulatory Commission (NRC) amend Special Nuclear Materials License SNM-2001, to delete condition 14(a) of SNM-2001, and replace it with a requirement that BWX Technologies (BWXT) submit a decommissioning plan for the Shallow Land Disposal Area (SLDA) in Parks Township, PA, by December 6,2000. On October 13,1998, BWXT provided additional information justifying the date for submitting the decommissioning plan and on January 19,1999, BWXT provided a I
detailed schedule for developing the decommissioning plan, showing the critical activities that are quired in order to develop the decommissioning plan.
We have reviewed the information in the aforementioned letters, and have concluded that the iniormation provided by BWXT is adequate to approve your license amendment request. We have also determined that this action qualifies for a categorical exclusion pursuant to NRC regulations at 10 CFR 51.22(c)(10), and, as such, the preparation of an Environmental /
Assessment is not required.
Amendment No.1 to SNM-2001, which deletes condition 14(a) of SNM-2001, and replaces it with a requirement to submit a decommissioning plan for the SLDA by December 6,2000, is enclosed. Although this amendment requires that BWXT submit the decommissioning plan for MWf I the SLDA by December 6,2000, we urge you to expedite the development and submission of ;
the decommissioning plan in order that the decommissioning of the SLDA can proceed as soon I as possible.
In order to keep NRC staff, and the public, informed of BWXT's progress in developing the decemmissioning plan for the SLDA, we would like to hold periodic meetings with BWXT staff while you are developing the decommissioning plan. During these meetings, BWXT staff would ;
discuss the status of the development of the decommissioning plan with NRC staff and address questions from the staff. As with most meetings between NRC staff and licensees, this meeting would be open to observation by members of the public and we would anticipate that we would address any questions from the public regarding the decommissioning of the SLDA at the conclusion of the meeting.
