EXEMPTION I.

Northeast Nuclear Energy -Company (the licensee) is the holder _ of PVovisional Operating License Noc DPR-21 which authorizes the nperation of'~~

Millstone Unit 1 (the facility) at the steady-state power levels not in excess of 2011 necawatts thermal. The facility is a f[oiTing water reactor lo ed

at the licensee's site in New London County, Connecticut. The license provides, among other thinos, that it is subiect to all rules, regulations and Orders of the Nuclear Reculatory Commission (the Commission) now or hereafter in effect.

Section 50.71(e)(3)(iii of 10 CFR Part 50 reauires that those plants initially sub,iect to the NRC's systematic evaluation proaram (SEP) nust file a complete updateTfinal safety-analysts report within 24 months after receipt of notification that the SEP has been completed.

By' letter dated March 16, 1983, the staff informed Northeast Nuclear Energy Company (NNECO) that SEP had been completed for Villstone Unit 1 and that, pursuant to 10 CFR 50.71(e)(3), the licensee was required to file an updated Final Safety Analysis Report (FSAP).

By letter da:ed February 4, 1985, the licensee reouested an exemption to

-defer submittal of the updated FSAR on the bases that the ongoing review would directly affect the content of the updated FSAR and that the required submittal would affect the work of the licensee's engineering personnel on issues of higher safety significance.

The NRC staff has reviewed the licensee's reouest for an exemption from the Millstone Unit 1 updated FSAR submittal date.

For most plants covered by

the~ 24-month interval allowed in the rhgulations. However, Millstone Unit ~r~

reouested participation in an_ expanded assessment of outstanding regulatory requirements with the idea of establishing an integrated schedule for"The.

completion of these issues in a resource efficient manner.

The staff is now implementing a limited Integrated Systematic Assessment Program (ISAP) for Millstone Unit 1.

Because the licensee had placed the updating of it: FSAR into its original integrated assessment proposal, the staff will be reviewing 'that licensing action as part of its screening review of ISAP related topics. The Commi~ssion has authorized the staff, in its policy statement on ISAP (49 FR 451121, to suspend specific existing imolementation

schedule requirements for plants to be reviewed under ISAP.

However, thii staff believes-thai a current FSAR is a vital and necessary tool in documenting the design bases of safety systems at Millstone Unit I as well as establishing the bases for future plant modifications and changes l

to technical specifications. While Millstone Unit I has shown good cause for the requested exemotion, the staff has determined that only a 6 ronth exemption i

  1. rom compliance with 10 CFR 50.71 is warranted at this time. Any additional exenptions from compliance with 10 CFR 50. 71 will be granted by the Director of Licensing only upon review and c'pproval of a procran plan containing schedules or milestones for the submittal of an updated FSAR for Millstone Unit 1.

The NRC sta#f considered safety aspects of the requested exemption from the'Tapdated-FSAR. submittal date. The proposed exemption affe;;ts only the required date for updating the FSAR and does not affect the risk of facility accidents. Thus the granting of'the reauested exemption will have no significent impect on plant safety.

~ The public interest will be served by granting the exemption sinceghe licensee can continue to use its personnel to complete other work of higher safety significance sooner than would be the case if personnel were diverted to update the FSAR immediately.

Based on its review, the staff concludes that issuance of this exemption will have no significant effect on plant safety.

Further, this action is in the publ'ic interest and good cause has been shown to support the exemptfor.

Therefo.re, a 6 month exemption from the date of issuance of this exemption is being granted by the staff for the submittal of an updated FSAR for Millstone linit 1.

Pursuant to 10 CFR 51.32, the Commission has determined that the granting of this exemption will have no significant impact on the environment (50 FR 13434, April 4, 1985).

III.

Accordingly, the Commission has determined that, pursuant to 10 CFR 50.12, an exemptinn is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest.

Therefore, the Commission hereby approves the following temporary exemption from compliance with 50.71(e).

Any additional. exemptions from compliance with 10 CFR 50.71 will be granted by the Director of Licensing only upon review and approval of a progran plan containing comprehensive schedules or milestones for the submittal of an updated FSAR for Millstone Unit 1.
