Gentlemen:
This refers to the routine safety inspection conducted by Messrs. Dennis Kubicki
and Joseph Ulie of the NRC on September 12-16 and October 11, 1988, of the fire
protection program at the Davis-Besse Nuclear Power Station authorized by NRC
Operating 1.icense No. NPF-3, and to the discussion of our findings with yourself
and other menbers of your staff at the conclusion of the insp*ction. This
inspection involved a limited scope fire protection program m iew including
a followup review of actions taken by your staff to resolve previously
identified NRC findings.
The enclosed copy of our inspection report identifies areas examined during
the inspection. Within these areas, the inspection consisted of a selective
examination of procedures and representative records, observations, and
interviews with personnel.
During this inspection, you identified that certain of your fire watch program
activities appeared to be in violation of NRC requirements, as described in the
enclosed Notice.
You also identified that your contractor implementing fire
watch requirements was falsifying records and you terminated that contract. With
respect to this item, the inspection showed that actions had been taken to
correct the root cause of the identified examples of the violation and to
prevent recurrence. Our understanding of your corrective actions are described
in Paragraph 3 of the enclosed inspection report. Consequently, no reply to
this violation is required and we have no further questions regarding this
matter at this time. We generally do not cite licensee identified violations
meeting certain criteria; however, because of the nature and scope of these
deficienc'es, we are fonnally documenting this violation. The NRC will
continue to monitor your oversight of the fire watch program since this
program, in part, was one of the compensatory measures previously required
to permit plant restart for interim operation untti the Davis-Besse Plant's
confonnance to the requirements of 10 CFR 50, Appendix R have been fully
accomplished.
In accordance with 10 CFR 2.790 of the Comission's regulations, a copy of this
letter and the enclosures will be placed in the NRC Public Document Room.
