SECTION 210 CO R AINT BY AGAINS' K ZE h 30uaskedio-myadviceonwhat cosition RIV should take f rom an enforcement stanapcint with regard tc the subject complaint filed with the Department of Labor unae-Section 210 of the Energy Reorganization Act of 1974, as amended.

Tne " Procedures for Implementing MOU Between NRC and DOL" provide that the NRC will not normally initiate enforcement action if DOL finds that no violatier of Section 210(a) occurred.

If, however, DOL finds that a violation has occurred, the NRC may take enforcement action under its Enforcement Policy, 10 CFR 2, Appendix C, including issuance of a Notice of Violation, imposition of civil penal ties, or issuance cf orders suspending, nodifying, or revoking licenses, but the NRC wil". normally consider the effect of the action taken by DOL before deciding on its action.

Therefore, unless there are extenuating Circurrstantes not knCwn to me, it is rny opinion tnat ne cnforcenent action should be initiated until such time as D0 's enfcrcement process has been completed.

This is consistent with the NRC's unce* standing with the D0L referenced aoove. Once tne DOL enforcement process has beer comoletec, however, consideration should properly be given to what enforcement actior., if any, should De taken by the NR.

Your attention is called te 10 CFR 50.7 (copy attached), a recently promulgatec regulation certaining to NR: enforcement with regard tc, the protected activities in Secticr. C10.
