SUBJECT:
NRC INTEGRATED INSPECTION REPORT NOS, 50-369/97-20 AND
50 370/97-20 AND NOTICE OF VIOLATION
-Dear Mr. Barron:
-
On January 24, 1998, the Nuclear Regulatory Commission (NRC) completed an
inspection at your McGuire 1 and 2 reactor facility. The enclosed report
presents the results of that inspection.
'
During the six-week period' covered by this inspection, your conduct of
activities at the McGuire facility was generally characterized by safety-
i
conscious cperations, sound engineering and maintenance. practices, and careful
,
radiological work controls. Good operational control of Unit 1 and restart of
Unit 2 from the refueling outage were identified. However, two violations of
'
NRC. requirements were identified and are cited in the enclosed Notice of
'
Violation (Notice). The circumstances surrounding the. violations are
_
described in detail in the enclosed report.
Both violations involved
repetitive issues.
,
.
Repetitive violations-are addressed in the NRC's " Statement of Policy and
Procedure for NRC Enforcement Actions " (Enforcement Policy). NUREG-1600
Section IV B.
The Enforcement Policy allows the severity level of a violation
to be increased if the violation can be considered repetitive,
For example, a
Severity Level IV violation.could be increased to Severity Level III with the
attending escalated enforcement action. However, in this case, we have
decided not to increase the severity level of the violations because of the
,
immediate corrective action that was taken and the: modifications being made to
your access control system to' prevent recurrence,

The NRC has concluded that information regarding the reason for the violations
'

(Violations 04.and105 of.Section 51.2), the corrective actions taken to
correct the violations and prevent recurrence..and the date when full
. compliance was achieved. is already adequately addressed on the docket in your

reply to a notice of violation letter, dated October 23, 1997.
Therefore, you
are not required to respond to this letter unless the description therein does
not accurately reflect your corrective actions or your position.
In that
case, or if you choose to provide additional information, you should follow
the-instructions specified in the enclosed Notice,
in accordance with 10 CFR 2.790(a) of the NRC's " Rules of Practice," a copy of
this letter and its enclosures will be placed in the NRC Public Document Room
(PDR),
