NOTICE OF-VIOLATION

Dear Mr. Anderson:

On October 25. 1997, the NRC completed an inspection at your Crystal River .3

reactor facility.

The enclosed report presents:the results of that

inspection.

During the 5-week. period covered by this inspection period, your conduct of

activities tc progress towards restart of your Crystal River facility was

.

generally characterized as acceptable. Three violations of NRC requirements

were identified: two in the area of Engineering and one in the area of Plant

Support.

These violations include 1) two examples of inadequate design of the

waste disposal system as described in the Final Safety Analysis Report (FSAR),

2) failure to perform a 10 CFR 50.59 safety evaluation within 90 days after

identification of a non-conforming condition, as required by procedure, and 3)

failure to-comply with the Off-Site Dose Calculation Manual surveillance

requirements for the waste gas decay tanks.

These violations are cited in the enclosed Notice of Violation, and the

circumstances surrounding the violations are described in detail in the

enclosed report.

Please note that you are required to respond to this letter

and should follow the instructions specified in the enclosed Notice when

preparing your response. The NRC will use your response, in part. to

determine whether further enforcement action is necessary to ensure compliance

with regulatory requirements.

The enclosed. Inspection Report also identifies activities that violated NRC

requirements that will not be subject to_ enforcement action because the

-licensee's efforts in identifying and correcting the violation met the

criteria specified-in Section VII.B. of the Enforcement Policy. Therefore, no

,

response with respect to these matters is required.
