Dear Mr. Mitchell:

This is in response to your letter dated June 12, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), a copy of the transcript of your testimony taken during the investigation (Case No. 1-84-014) '

regarding allegations of harassment of quality assurance auditors at Nine Mile Point Unit 2.

l Copies of the investigation report and accompanying exhibits have been made available for public inspection and copying at the NRC Public Document Room (PDR) in Washington, DC 20555, in the PDR docket file for the Nine Mile Point plant. Enclosed is a copy of the notice that provides procedures and charges 1 for obtaining copies of records from the PDR in order that you may obtain copies of the report and transcript of your testimony (exhibit 34) and any other exhibits in which you may be interested. Copies of the report and exhibits are also available at the NRC Local Public Document Room for the Nine Mile Point Plant, which is located at the following address.

i Some portions of the released records were withheld p(ursuant to Exemptions (6), (7 and 10 CFR 9.5(a)(6), (7)(iii) and (7)(iv) of the Commission's regulations.

The denial may be appealed to the Secretary of the Commission within 30 days

from the receipt of this letter. Any such appeal must be in writing, 1

addressed to the Secretary of the Commission, U. S. Nuclear Regulatory i Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." We note in this regard that there is a pending lawsuit, Ryan v. Nuclear Regulatory Commission, D.D.C. 86-1553, regarding the release of the report and exhibits.
