EMERGENCY ACTION LEVEL CHANGES - MCGUIRE NUCLEAR STATION, UN!TS 1 AND 2 (TAC NOS. M94491 AND M94492)

Dear Mr. Serron:

By letter dated December 27,1995, as supplemented by letters dated April 1 and October 23, 1997, you requested NRC approval of the proposed emergency action levels (EALs) to the McGuire Nuclear Station, Units 1 and 2. The proposed EALs incorporate the guidance in NUMARC/NESP-007, oevision 2," Methodology for Development of Emergency Action Levels."

NUMARC/NESP-007 was endorsed by the NRC staff in Regulatory Guide 1.101, Revision 3,

" Emergency Planning and Preparedness for Nuclear Power Reactors," as an acceptable method for meeting the requirements of 10 CFR 50.47(b)(4) and Appendix E to 10 CFR Part 50.

As stated in the enclosed Safety Evaluation, the NRC staff concludes that the changes meet the requirements of 10 CFR 50.47(b)(4) and Appendix E to 10 CFR Part 50. However, the approval of the proposed EALs is contingent on Duke Energy discussing and obtaining an agreement from the offsite authorities before implementation.

The staff considers this matter resolved and TAC Nos. M94491 and M94492 closed.
