GRANTING OF RELIEF FROM THE DATE OF IMPLEMENTATION OF THE REQUIREMENTS OF ASME SECTION XI, SUBSECTION IWE, AS ENDORSED IN AMENDMENT TO 10 CFR 10.55a (TAC NO. M99449) i
Dear Mr. Anderson:
By letter dated August 21,1997, as supplemented October 30,1997, you requested relief from the American Society of Mechanical Engineers Boller and Pressure Vessel Code (ASME Code),Section XI, Subsection IWE/lWL. The request for relief is applicable to the Crystal River Nuclear Generating Unit 3 (CR 3) Repair and Replacement program for contrinment components and structures. You requested relief until December 31,1997, or CR-3 restart from its current outage, whichever occurs first.
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the subject request for relief from the requirements to implement the 1992 Edition of the ASME Code,Section XI, Subsection IWE, as it was modified and incorporated by reference to 10 CFR 50.55a through an amendment of the rule as published in Federa/ Reaister Notice No.154, Volume 61, dated August 8,1996. Our evaluations and conclusions are contained in the enclosed Safety Evaluation. The staff agrees that the immediate implementation of the requirements of the ASME Code for repair and replacement activities, as required by 10 CFR 50.55a, would result in hardship without a compense. ting increase in the level of quality and safety.
Based upon evaluation of your request, the staff concludes that your proposal provides adequate assurance of containment integrity for the period requested. Accordingly, FPC's relief 9
