Gentlemen:

SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORTS NO. 50-266/86005[DRSS];

50-301/86005[DRSS])

This refers to the special physical security inspection conducted during the

period April 2-10, 1986 at the Point Beach Nuclear Plar.t, Units 1 and 2, Two

Rivers, Wisconsin.

The results of the inspection were discussed on April 15,

1986 during an enforcement conference in the Region III office between

Mr. C. W. Fay and other members of your staff and myself and other members of

the Region III staff.

The inspection identified two violations of NRC requirements. The first

violation involved the degradation of a vital area barrier which could have

allowed unauthorized, undetected access into a vital area of your facility.

The other violation occurred as a result of your improper classification of

the degraded vital area barrier which led to a late notification to NRC

officials. The violations reflect a veakness on your part to fully implement

and maintain in effect the provisions of your NRC-approved Physical Security

Plan and the reporting requirements of 10 CFR 73.71(c).

Violation A described in the enclosed Notice has been categorized as a Severity

Level III violation in accordance with the " General Statement of Policy and

Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985).

Normally, a civil penalty is proposed for a Severity Level III violation.

However, after consultation with the Director, Office of Inspection and

Enforcement, I have decided that a civil penalty will not be propused in this

case.

In reaching this conclusion, we considered your self-identification of

the event, your prompt and extensive corrective action, and your prior good

performance in the area of security as demonstrated by a Category 1 rating in

your most recent Systematic Assessment of Licensee Performance (SALP).

you should describe those actions taken or planned that are designed to

increase the ef fectiveness of your security program, particularly with regard

to ensuring access control requirements are satisfied. After reviewing your

response to this Notice, including your proposed corrective actions, the NRC

will determine whether further NRC enforcement action is necessary to ensure

compliance with NRC regulatory requirements.

The material enclosed contains Safeguards Information as defined by 10 CFR 73.21

and its disclosure to unauthorized individuals is prohibited by Section 147 of

the Atomic Energy Act of 1954, as amended. Therefore, with the exception of

the cover letter, this material will not be placed in the Public Document Room.

The responses directed by this letter and the enclosures are not subject to

the clearance procedures of the Office of Management issued under the Paperwork

Reduction Act of 1980, PL 96-511.

Effectiveness: Security Organization; Records and Reports; Testing and

Maintenance; Physical Barriers - Vital Areas; Access Control - Personnel;

Training and Qualification - General Requirements and the Safeguards

Contingency Plan.

Portions of the following additional inspection modules

areas were also reviewed:

Physical Barriers - Protected Areas; Compensatory

Measures; Detection Aids - Protected Area and Alarm Stations.

Results: The licensee was found to be in compliance with NRC requirements

during this inspection except as noted below:

Physical Barriers - Vital Areas: A vital area barrier was degraded for

Records and Reports: A security event was not reported in a timely manner.
