CERTIFICATE AMENDMENT REQUEST - PORTSMOUTH GASEOUS DIFFUSION PLANT (PORTS) CLARIFICATION OF COMMITMENTS AND COMPLETION DATE EXTENSION RELATED TO ISSUE 24 OF THE " PLAN FOR ACHIEVING COMPLIANCE WITH NUCLEAR REGULATORY COMMISSION REGULATIONS AT THE PORTSMOUTH GASEOUS DIFFUSION PLANT DOE /ORO-2027/R3 (COMPLIANCE PLAN) (TAC NO. L32051)

Dear Mr. Miller:

This refers to two of your letters dated October 21,1997, entitled " Certificate Amendment Request - Calibration Program for Measuring and Test Equipmeni," and December 17,1997, entitled " Request for Enforcement Discretion Regarding the Ceitificate Amendment Request (CAR) for Compliance Plan issue 24.* In accordance with the Memorandum of Understanding between Department of Energy (DOE) and NRC, which appeared in the Federal Reaister on November 5,1997, the NRC forwarded your CAR to DOE on November 7,1997, for their review and approval of the requested dats change. By letter dated December 8,1997, DOE recommended approval of the requested date change. Anticipating NRC's approval of the CAR to occur after the completion date of December 31,1997, which you have requested to extend to June 30.1998, and to avoid a potential noncompliance of not meeting a Compliance Plan completion date, you submitteo a request for enforcement discretion on December 17,1997.

- The NRC has determined that decpite the CAR having been submitted in a timely fashion, from December 31,1997, until the NRC's final decision is issued on this matter, a literal violation of an NRC requirement would exist. However, after consideration that the remaining circumstar":es of this issuo comply with Section Vll.B.1 of the General Statement of Policy and Procedares for NRC Enforcement Actions, the NRC has determined in this case not to cite the violation. The NRC staff anticipates completing its CAR review by January 30,1996.
