DISPOSITION OF THE HAMPTON FALLS CONTENTION NO. 1 The State of New Hampshire hereby moves this Board to enter an order summarily disposing of Contention Hampton Falls No.
1.
This contention as admi,tted by the Board in its April 29, 1986 Memorandum and Order raises the issue of "whether the emergency plan of Hampton Falls will be implemented.'

On this limited issue it in the position of the State of New Hampshire that insofar as the Town of Hampton Falls is unable (for whatever reason) to provide bhe necessary emergency response capabilities for the Town, then the State of New Hampshire will provide such capabilities in conformance with the New Hampshire Compensatory Plan.

1 STATEMENT OF MATERIAL FACTS NOT IN DISPOTE 1.
In the event that the Town of Hampton' Falls.is unable or unwilling to provide for its,necessary emergency response capabilities, then the State of New Hampshire can and will implement the llew Hampshire Compensatory Plan, so-called, in order to provide such capabilities.
