Dear Mr. Philips:
This is in partial response to your letter dated March 17, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of SECY-85-306A, SECY-85-306B, and any documents related to those two staff papers.
The documents identified on enclosed Appendix A are being released at Comissioner Asselstine's discretion and are being placed in the NRC Public Document Room (PDR) located at 1717 H Street, NW, Washington, DC 20555, in file folder F01A-86-194 in your name.
Portions of the documents identified on enclosed Appendix B, and documents 1 through 25 identified on enclosed Appendix C contain the predecisional analyses, opinions, and recommendations of the Commissioners, and between the Commissioners and their staffs, on the implementation of Appendix R to 10 CFR Part 50. Documents 26 and 27 on Appendix C contain the predecisional legal advice, analyses, opinions and recommendations of the Office of the General Counsel (0GC) to the Commissioners on the implementation of Appendix R to 10 CFR Part 50. Because the documents reflect the predecisional process among the Commissioners, between the Commissioners and their staffs, and between OGC and the Commissioners, the documents are exempt from mandatory disclosure pursuant to Exemption 5 of the F0IA, 5 U.S.C. 552(b)(5), and the Commission's regulations at 10 CFR 9.5(a)(5).
Release of the infonnation would tend to inhibit the open and frank exchange of ideas essential to the deliberative process. The releasable portions of the documents on Appendix B are being placed in the PDR in file folder F01A-86-194 in your name. The documents on Appendix C contain no reasonably segergable factual portions and are being withheld in their entirety.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it hr.s been determined that the information withheld is exempt from production or disclosure and that

its production or disclosure is contrary to the public interest. The person responsible for the denial of the documents on Appendix B, and documents 1 through 25 on Appendix C is Mr. John C. Hoyle, Assistant Secretary of the Commission. The person responsible for the denial of documents 26 and 27 on Appendix C is Mr. James A. Fitzgerald, Assistant General Counsel.

from the receipt of this letter. Any sucn appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
SECY-85-306A and SECY-85-306B were addressed in our response to a previous F0IA request, F01A-86-92, and were withheld in their entirety. A copy of our response to that F0IA request is available in the PDR in folder F01A-86-92 under the name Graber.
The search for and review of documents that are subject to your request are continuing. We will notify you upon completion of the search and review.
