UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Safety Evaluation Report Materials License No. SNM-1270 Amendment No. 12 Docket No. 70-1220 By application dated July 1, 2020, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20183A280) GE-Hitachi Nuclear Energy (GEH) requested an amendment to Materials License No. SNM-1270. GEH requested that the license be modified to change the authorize the place of use to include in private carriage between authorized recipients within the United States.

Materials License No. SNM-1270, authorizes GE-Hitachi Nuclear Energy Americas, LLC, to possess special nuclear material (which may be irradiated), source material, and byproduct material, in packages approved pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 71, for the purpose of delivery of this material to a carrier for transport in private carriage. GEH requested this approval to authorize it to possess the material between and NRC-licensed facility and an authorized recipient (such as a National Laboratory which is authorized by the Department of Energy to receive the material), regardless of whether that recipient is an NRC-licensed entity. Since the license requires that the GEH transport the material in a package approved pursuant to Title 10 of the Code of Federal Regulations, Part 71, Packaging and Transportation of Radioactive Material, this license is used in lieu of the general license in 10 CFR 71.17. In addition, The license, as amended, applies to special nuclear material used only in research and development activities, as defined in 10 CFR 70.4. Therefore, the categorical exclusion of 10 CFR 71.51.22(c)(14)(v) applies and neither an environmental assessment nor an environmental impact statement is warranted.

As requested by the applicant, the license has been revised to change the authorized place of use to between authorized recipients. In addition, a typographical error was corrected in Condition 11, such that Condition 11 states to inspect and monitor the loading of each package to verify. Previously, the word and was an.
