SUBJECT:
RELEASE OF PROPOSED DOCUMENTS This memorandum is to advise you, in accordanc'e with Management Directive (MD) 3.4, of releases of proposed documents and to advise you of our corrective actions. While the releases were not done in strict accordance with MD 3.4, the information contained in the documents was not considered to be sensitive information.
NMSS conducted a self-assessment in response to concerns you raised regarding the inappropriate release of documents. Through this self-assessment, we found that it has been common practice in NMSS to release proposed license conditions and environmental assessments (EAs) to licensees for review prior to issuing the license or EA. The purpose has been to have the licensee check for factual errors and to identify any potential compliance problems. Such releases have been routinely authorized by Branch or Division managers.
However, MD 3.4 requires Office Director approval for these releases. Recent examples include the following:
(1) release of a proposed EA for a license amendment requested by Molycorp, Inc.,
to the public and the licensee, for discussion at a public meeting; (2) release of proposed exemption conditions to Envirocare of Utah, Inc., concerning possession limits for special nuclear material; and (3) release of proposed license conditions to BWXT, Inc. concerning decommissioning of its Parks Township, PA, site (4) release of proposed license conditions to Nuclear Fuel Services (NFS) in connection with license renewal Except in the case of NFS example, a copy of the proposed license conditions and EAs were placed in the respective docket files and Public Document Room (PDR) at the time of release.
As corrective actions, an electronic reminder has been sent to all NMSS staff on the importance of controlling predecisional information, the attached memorandum on control of proposed documents is being sent to all NMSS employees, and I am advising managers to discuss Management Directive 3.4 with their staff. In addition, OGC is scheduled to provide refresher

overview training for management on this topic an answer questions.

authorization in my memorandum to transmit these proposed documents by letter to licensees 9 for comment, and also simultaneously place them in the Public Document Room, as long as the l
documents do not relate to potential enforcement actions or Senior NRC management or j
